Abstract
5237 Sayılı Türk Ceza Kanununun 99.maddesinde düzenlenen çocuk düşürtme suçu detaylı olarak incelendiğinde, birçok eksiklik ve çelişkiyi içinde barındırdığı görülecektir. Bu suç tipi üzerinde yeteri kadar bilimsel çalışmanın yapılmamış olması, kanuni düzenlemede gebe kadının irade serbestisi ile ceninin gelecekteki yaşamının korunması arasında bir dengenin sağlanmamış olması gibi nedenlerin doğurduğu sıkıntılar, uygulamada kendisini etkili bir şekilde göstermektedir. Bu çalışmamızda, çocuk düşürtme suçu ceza hukuku açısından incelenecektir. Bu kapsamda, suçun koruduğu hukuksal değer, suçun unsurları, şahsi cezasızlık sebebi, nitelikli halleri ve yaptırımı, tartışmalı olan hususlara değinilerek ele alınacaktır.
When analyzed in detail, it will be noticed that illegal abortion, specified under article 99 of Turkish Penal Code numbered 5237, contains numerous deficiencies and contradictions. Inconveniences caused by lack of sufficient scientific studies on this type of crime and unprovided balance between freedom of will of pregnant woman and protection of future life of fetus in legal regulation come into prominence in practise. In this study, illegal abortion is analyzed from the viewpoint of criminal law. In this context, the legal good as protect by the crime, elements of crime, aggravating circumstances and punishment of crime are handled referring to contentious points.
