Azınlık fıkhı çerçevesinde Avrupa fetva ve araştırma konseyi : örnek fetvalar

Abstract

İkinci Dünya Savaşı sonrası, merkezinde ekonomik sebeplerin bulunduğu bazı gerekçelerle İslam ülkelerinden Batı’ya göçler yaşanmıştır. Batı’da Müslüman toplum varlığının artmasıyla, özellikle dini pratiklerin hayata geçirilmesindeki sorunların da arttığı gözlemlenmiştir. Bu durum Müslüman toplumun sorunları ile ilgilenecek kuruluşların ortaya çıkmasına sebep olmuştur. Müslüman toplumun sorunlarının fıkhi çözümünde en çok ihtiyaç duyulan konu, mahallinde çözümlerin üretilebileceği bir anlayışın geliştirilmesidir. Bu ise sorunun ortaya çıktığı ülkede yaşayan, toplumun sosyolojik tahlilini yapabilen, demografik yapısının farkında olan kişiler ile mümkündür. Bu kişilerin yer aldığı komisyonlardan biri de Avrupa Fetva ve Araştırma Konseyidir. Bu çalışmada söz konusu konseyin yapısı, üyeleri ve vermiş oldukları fetvaların yöntemi bazı örnekler üzerinden ele alınarak incelenmiştir.There were migrations from Islamic countries to the West due to basically some economic reasons in the center after the Second World War. With the increase in the Muslim community in the West, it has been observed that especially problems in the implementation of religious practices have increased. This situation led to the emergence of organizations that will deal with the problems of the Muslim community. The most needed issue in the solution of the problems of the Muslim community is the development of an understanding where solutions can be produced in the neighborhood. This is possible with people who live in the country where the problem arises, who can make a sociological analysis of the society and who are aware of their demographic structure. One of the commissions involving these people is the European Fatwa and Research Council. In this study, the structure of the council in question, its members and the method of the given fatwas have been examined through some examples.
