Publication: İşverenin 4857 sayılı kanuna göre iş akdini haklı nedenle feshi
Abstract
Tez çalışmam üç bölümden oluşmaktadır. Birinci bölümde iş sözleşmesinin sona ermesi kavramı üzerinde durularak, sona erme hallerinden bahsedilecektir. İkinci bölümde ise esas çalışma konum olan 4857 sayılı İş Kanuna göre işverenin haklı nedenle derhal feshi konusu ele alınacaktır. Çalışmamın devamı olan üçüncü bölümde haklı nedenle feshin hüküm ve sonuçları ile haksız feshin sonuçlarına yer verilecektir. İşçinin iş sözleşmesinin sona erdirilmesi çoğu zaman tek geçim kaynağının elinden alınması ve kendisiyle birlikte diğer aile fertlerinin de zorluğa düşmesi olarak sonuçlanacaktır. Bu noktada işverenin haklı nedenle iş sözleşmesini sona erdirmesi de daha ağır sonuçlar getirecektir. Öyle ki derhal fesih ile işçi ihbar tazminatını alamayacağı gibi bazı hallerde kıdem tazminatına da hakkı olmayacaktır. Bu sebeple iş akdinin derhal fesheden işverenin bu hakkını hangi sebeplerle ve hangi şekilde kullanabileceğinin saptanması önem arz etmekte olup, çalışma konum 4857 sayılı İş Kanunun 25. maddesi çerçevesinde Yargıtay kararları ve öğretinin görüşleri ışığında anlatılacaktır.
My thesis composed of three parts. In the first section, the concept of expiration of employment agreement will be emphasized and the conditions of expiration will be mentioned. In the second section, the right of termination based on just cause of the employer in accordance with the Labor Code numbered 4857 will be emphasized that is the main subject of my thesis. In the third section, which is a continuation of my thesis, the terms and results of termination based on just cause and the results of unjust termination will be explained. Termination of an employee's employment agreement will often result in the disappearance of employee's only means of livelihood and as well the run into of employee's family members in a financial difficulty. At this point, termination of employment agreement based on just cause by the employer may also result in more severe consequences. Such that; the employee shall not receive notice pay or in some cases shall not be entitled to severance pay with immediate termination.Therefore, it is important to determine the reason and the manner in which this right of the employer who terminates the employment agreement immediately. My thesis issue will be explained within the framework of article 25 of the Labor Code numbered 4857 and the decisions of the Supreme Court and the views of the doctrine.
