Abstract
Dört sünnî amelî mezhepten biri olan Mâlikî Mezhebi, Medine’de İmam Mâlik’in ders halkasında temelleri atıldıktan kısa süre sonra, henüz Mâlik hayatta iken Mısır ve Kuzey Afrika üzerinden Endülüs’e ulaşmış; burada resmî mezhep olarak kabul edilmiştir. Zamanla Endülüs’te dikkate değer bir Mâlikî birikimi oluşmaya başlamıştır.Hicrî 450’de Kurtuba’da doğan ve 520’de yine Kurtuba’da vefat eden Dede İbn Rüşd, Endülüs Mâlikî fakihlerinin en önde gelen isimlerindendir. Gerek tedris gerekse telif faaliyetleri ile mezhebe ciddi katkılar sağlamıştır. Bu çalışmada öncelikle girişte onun içerisine doğduğu ilmî ortam olan Endülüs Mâlikîliği ve tarihi seyri hakkında kısaca bilgi verilmiş; birinci bölümde hayatı, ilmî şahsiyeti, hoca ve talebeleri ile eserleri hakkında bilgi verilmiştir. İki ve üçüncü bölümlerde mezhebe katkıları farklı açılardan incelenmiştir. “Mezhep birikiminin aktarılmasına Yönelik faaliyetleri” adını taşıyan ikinci bölümde mevcut mezhep birikiminin tespit edilmesi, temellendirilmesi ve bu birikimin doğru bir şekilde bir sonraki nesle aktarılması noktasındaki çalışmalarına odaklanılmıştır. “Mezhep içi istidlal faaliyetleri”nin ele alındığı üçüncü bölümde ise, İbn Rüşd’ün, Mâlikî mezhebi müntesibi bir fakih olarak, mezhep birikimini dikkate alarak gerçekleştirdiği fıkhî faaliyetleri; tercîh, mezhep asıllarının tespiti, tahrîc, tevcîh başlıkları altında irdelenmektedir.
Māliki maḏhab, one of the four Sunni legal schools, soon after it was founded in Madinah through the teachings of Imam Mālik reached Andalusia in a very short time through Egypt and North Africa during the lifetime of Imām Mālik and got acceptance there as an authorized madhhab. By the time, it started to become a significant Māliki accumulation in Andalusia. Ibn Rušd al-Jadd, who was born in Cordoba in the 450 of hegira and died there in 520, is one of the most prominent scholars among Andalusian Māliki jurisprudents. He contributed to the maḏhab in both education and compilation. In the introduction of the thesis, short information has given about the educational environment, which contains Andalusia’s Māliki maḏhab, and its historical progress in which he was born. The first part includes the information about his life, his scholarly personality, his teachers and students, and his books. The second and third part examine his contributions to Māliki maḏhab from different perspectives. The second part, named “The activities about the transition of Maḏhab’s accumulation”, focuses on the identification of present madhhab’s accumulation, on its foundings and its transition to next generation properly. As for the third part, which focuses “His Inter-sect deduction activities”, it addresses jurisprudential activities of Ibn Rušd as a Māliki jurisprudent, which he executed while considering the maḏhab’s accumulation under “preference”, “determination of maḏhab’s essentials”, “extraction”, “directing” and “deduction” headings.
