Hans Kelsen'de hukuki geçerlilik ve temel norm

Abstract

Hans Kelsen’ in hukuki geçerlilik anlayışını ve temel norm kuramını açıklamayı amaçlayan bu tez, iki bölümden oluşmaktadır. İlk bölümde, hukuki geçerlilik kavramının farklı hukuk doktrinlerindeki görünümüne değinilip Kelsen’ in geçerlilik anlayışına yer verilmiştir. Buna bağlı olarak Kelsen’ in norm anlayışı ayrıntılı olarak incelenmiştir. Tezin ikinci bölümü ise temel norma ayrılmıştır. Temel norm, gerek Kelsen’ in geçerlilik anlayışı gerekse hukuk kuramının bütünü için merkezi önem arz etmektedir. Kelsen’ in uzun yıllar sürdürdüğü temel norm kuramı, bu süre içerisinde bazı değişikliklere uğramıştır. Kelsen’ in saf hukuk kuramının zaman içerisindeki evrimine de ışık tutan bu değişimler, ikinci bölümde kronolojik incelenmiştir. Ayrıca temel norma ilişkin başlıca eleştirilere ve düşüncelere yer verilmiştir.

This thesis, which aims to explain Hans Kelsen's understanding of legal validity and basic norm theory, consists of two parts. In the first part, the appearance of the concept of legal validity in different legal doctrines is mentioned and the validity understanding of Kelsen is given. Accordingly, Kelsen's understanding of the norm was examined in detail. The second part of the thesis is devoted to the basic norm. The basic norm is central importance for both of Kelsen's understanding of validity and the overall theory of law. The basic norm theory that Kelsen has pursued for many years has undergone some changes during this period. These changes, which shed light on the evolution of Kelsen's pure law theory over time, are examined chronologically in the second part. In addition, major criticisms and thoughts on the basic norm are included.
