Bahrî Memlükler’de dımaşk kâdılkudâtları

Abstract

Erken dönem İslâm toplumlarında kadılık müessesesi bulunmaktaydı. Ancak yargı sisteminde önemli değişiklik dört mezhepten birer kâdılkudât atanması ile Memlük Devletin’de oldu. Atamalar ilk önce başkent Kahire’de ardından Dımaşk’ta gerçekleştirildi. Söz konusu atamalardan önce Memlükler de selefleri Eyyûbîler gibi sadece Şâfiî kâdılkudât tayin etmekteydi. Bu tez, Memlük Sultanı Baybars’ın 664 (1266) yılında dört mezhepten birer kâdılkudât atamasını yapmasından Bahrî Memlükler döneminin sona erdiği yılına kadarki Dımaşk kâdılkudâtlarını ele almaktadır. The office of judge has existed in early Islamic society. But an important change in the judicial organization of the Mamluk state occurred with the establishment of a chief judge for each of the four schools of law. The appointments were made first in capitol city Cairo and then Damascus. Before a new development the Mamluks, as well as their predecessors, the Ayyubids, had only a single Shafi chief judge. This thesis covers from the Mamluk Sultan Baybars ordered the investiture of a chief judge a chief judge for each of the four schools of law in the year 664 (1266) to end of the Bahri Mamluk Period in 784 (1382).
