Abstract
Tez, İş ve Sosyal Güvenlik Hukuku’na göre Türkiye’de yabancı personel istihdamı konusunu tüm yönleriyle açıklamaktadır. Öncelikle yabancı kavramı ve yabancı türleri ayrıntılı olarak açıklanmıştır. Daha sonra yabancıların Türkiye’de çalışma haklarına ilişkin mevzuat hakkında genel bilgi verilmiştir. Yabancıların Türkiye’ye girişleri, çıkışları, ikamet ve seyahatleri de yine ayrıntılı olarak açıklanmaktadır. Yabancıların Türkiye’de Çalışma Hak ve Özgürlükleri de Tez’de açıklanan konular arasındadır. Bu konu içerisinde çalışma izni, çalışma izni çeşitleri, çalışma izninin sona ermesi, çalışma izni isteminin reddi, iznin iptali ve geçerliliğinin kaybı kararları ayrıntılı olarak açıklanmıştır. Ayrıca çalışma amaçlı ikamet izni ve Yabancıların çalışmasının yasaklandığı iş ve meslekler de Tez’de açıklanan konular arasında yer almaktadır. Tez’de açıklanan bir diğer konu da, çalışma izni alınmamasının iş sözleşmesine etkisidir. Yabancı işçilerin Toplu İş Hukuku ve Sosyal Güvenlik Hukuku kapsamında yararlanabilecekleri haklar da Tez’de ayrıntılı olarak açıklanmıştır. Son olarak İşsizlik Sigortası konusunda da Tez’de ayrıntılı olarak bilgi verilmiştir. The purpose of this thesis is to explain employment of foreigner employees in Turkey according to Labor and Social Security Law. First, the meaning foreigner as a term and types of foreigners are explained in details. A general information of the legislation in Turkey about foreigner's right of work is given. Foreigners' entry and exit Turkey, residence and traveling in Turkey are also explained in details. Working rights and freedom of foreigners in Turkey are one of the other subjects explained in this thesis. Work permit, types of work permit, expiration of work permit, rejection of work permit request, cancellation of work permit and invalidation of work permit decisions are explained in details. Entry and registry permit of work purpose and jobs and businesses prohibited to foreigners are also explained in this thesis. Another subject explained is the effect of lacking of work permit to the employment contract. Foreign employees' rights, which foreign employees may benefit by and which arise from Collective Labor Law and Social Security Law are also explained in details. Information about Unemployment Insurance is also given in this thesis.
