Publication: İslam hukuku açısından hastanın tedaviyi reddetme hakkı bağlamında aşı meselesi
Abstract
İslam hukuku birçok disiplinle ilişkili olmakla beraber toplumsal hayatın önemli bir parçası olan tıbbi bilgi ile de yakından alakalı olup tıp meselelerinin İslam hukuku çerçevesinde incelenmesi büyük bir önem arz etmektedir. Daha çok tedavinin etik yönü üzerine yoğunlaşılan bu çalışmalarda hastayı ilgilendiren her husus, üzerinde düşünülmesi gereken hassas noktalardır. Bu çalışmada ise İslam hukuku açısından hastanın tedaviyi reddetme hakkı aşı örneği üzerinden incelemektedir. Kişinin tedavi talebinin ardından hangi sebepler ile ret kararına ulaşıldığı, hastanın hiçbir şekilde tedaviye yanaşmak istememesi durumları ve bu kararını hangi sebeplere dayandırdığı sorusunun cevabı aranmaktadır. Ayrıca bu sorunun cevabının aranabileceği birçok örneğin incelenmesi mümkün olmayacağı için toplumsal açıdan öncelikli ve önemli bir konu olan aşı meselesi üzerinden bir değerlendirme yapılmasının uygun olacağı öngörülmektedir. Bu çalışmada ise öncelikli olarak hastanın tedavi hakkında bilgilendirme boyutu ve hastanın rızası ele alınmaktadır. İkincil olarak hastanın ret hakkı imkanının sorgulanması, hasta ehliyeti ve bu ehliyetin bağlı olduğu durumlar sunulmaktadır. Son olarak farklı yönlerden incelenen aşı meselesine dair başta fıkhi olmak üzere etik ve hukuki bir değerlenmeler yapılmaktadır. Tez, literatür açısından ilk olup alandaki diğer çalışmalara öncülük etmesi umulmaktadır.
Although Islamic law is related to many disciplines, it is also closely related to medical knowledge, which is an important part of social life, and it is of great importance to examine medical issues within the framework of Islamic law. In these studies, which mostly focused on the ethical aspect of treatment, every issue that concerns the patient is sensitive points that need to be considered. In this study, it examines the patient's right to refuse treatment in terms of Islamic law through the sample of vaccines. The answer to the question of the reasons why the refusal decision was reached after the treatment request of the person, the situations in which the patient did not want to approach the treatment in any way and the reasons on which this decision was based is sought. In addition, since it will not be possible to examine many examples for which the answer to this question may be sought, it would be appropriate to make an assessment on the vaccine issue, which is a socially prioritized and important issue. In this study, first of all, the dimension of informing the patient about the treatment and the patient's consent is discussed. Secondly, questioning of the patient's right to refuse possibility, patient's license and situations related to this license are presented. Finally, by examining the vaccine issue within this framework, a legal interpretation and a medical, ethical and legal evaluation are made. The thesis is the first in the literature and it is hoped that it will give priority to other studies in the field.
