Publication: Esnek çalışma modellerinde sosyal güvenlik uygulamaları
Abstract
Bu çalışma ile temel olarak amaçlanan son yılların güncel konularından biri olan esnek çalışma uygulamalarının, sosyal güvenlik mevzuatındaki yeri ve uygulama ilkelerinin detaylı olarak açıklanmasıdır. Ülkemizde esnek çalışmanın gün geçtikçe artan uygulaması, bu tezi ortaya çıkaran itici güç olmuştur. Çalışmamızda konu üç ana bölümde incelenmiştir. İlk bölümde, genel olarak esneklik ve esnek çalışma kavramları üzerinde durulmuş; esnek çalışmanın tarihsel gelişimi ile türleri açıklanmaya çalışılmıştır. İkinci bölümde, iş hukukumuzda yer alan esnek çalışma modellerinden sosyal güvenlik uygulamaları bakımından farklılık arz edenler ele alınmıştır. Üçüncü ve son bölümde ise bu esnek çalışma modelleri, sosyal güvenlik hukukundaki düzenlemeler yönünden değerlendirilmiştir. Bu bağlamda “4857 sayılı İş Kanunu” ile “5510 sayılı Sosyal Sigortalar ve Genel Sağlık Sigortası Kanunu”nda mevcut düzenlemelerle birlikte konuyla bağlantılı ikincil mevzuat hükümlerinden de faydalanılmıştır. Aynı zamanda çalışmada literatür taramasının yanı sıra Yargıtay kararlarına da değinilmiştir. Yapılan inceleme neticesinde, günümüz piyasa koşullarında çalışma ilişkilerinin esnek çalışma uygulamalarından bağımsız olarak düşünülmesinin mümkün olmadığı; ancak sosyal güvenlik mevzuatındaki konuya ilişkin düzenlemelerin yetersiz ve zaman zaman da çalışanları dezavantajlı konumda bırakabilecek nitelikte olduğu sonucuna varılmıştır.
The main purpose of this study is to explain in detail the flexible working practices, which is one of the current issues of recent years, as its place in the social security legistation and practice principles. The daily increase of flexible working in our country has been the driving force that led to this thesis. The subject was analysed in three main parts in our study. In the first part, generally flexibility and flexible working concepts are emphesized; the historcal development of flexible working and its types have been tried to be explained. In the second part, ones that differ in terms of social security practices among the flexible working models in our labour law are discussed. In the third and the last part, these flexible working models are evaluated in terms of regulations in social security law. In this sense in addition to the regulations in the Labor Law No. 4857 and the Social Insurance and General Health Insurance Law No. 5510, secondary legislation provisions related to the subject are also benefited from. Also in addition to the literature review, the Supreme Court desicions are included in the study. As a result of the research, it is concluded that it is not possible to consider working relations independent from flexible working practices in today’s market conditions; rather the regulations in the social security legistation on the subject are insufficent and have the quality to leave the employees in a disadvantageous position from time to time.
