Abstract
anma, Kazâî boşanma. ÖZET İSLAM VE TÜRK HUKUKUNDA KAZÂÎ BOŞANMA SEBEPLERİ Kazâî boşanma, tek veya iki kişinin iradesinin yanında, hâkimin kararına ihtiyaç duyulan boşanma şeklidir. İslam Hukukçuları kazâî boşanmayı boşanma yöntemi olarak kabul etmiş, ancak hangi sebeplerin kazâî boşanmayı gerekli kılacağı hususunda ihtilaf etmiştir. Bu çalışmada İslam Hukukçularının benimsediği kazâî boşanma sebepleri ile Medenî Hukuktaki boşanma sebepleri çeşitli açılardan incelenmiştir. Ayrıca konunun insan ve toplum yaşamı üzerindeki ehemmiyeti açısından, pratikte en sık başvurulan boşanma sebepleri araştırılmıştır. Bu doğrultuda çeşitli araştırmalar incelenmiş, avukat ve psikologlarla görüşmeler yapılmıştır.İncelenen araştırmalar ve yapılan görüşmelerle günümüzde insanları boşanmaya iten sebeplerin tespitine çalışılmıştır. THE REASONS OF JUDICIAL DIVORCE IN THE ISLAMIC AND TURKISH LAW Judicial Divorce is the type of divorce in which there is a necessity for the decision of judge together with the will of one or both sides of the parties. The Jurists of Islamic Law accepted the the Judicial Divorce as a way of legal divorce but they have been dissident on the reasons causing the case of Judicial Divorce. In this study the reasons accepted by Islamic Law Jurists as the causes for Judicial Divorce and the reasons for divorce in the Turkish Civil Law are studied from different asdpetcs. Morover the most frequent ways being used by the society in practice were studied in terms of their affects and importance for the social and individual lives. For this purpose, some researches on this subject were studied and a couple of interviews with some lawyers and psychologists were realized. By studying these researches and realizing these interviews, it was targetted to find out the reasons causing people to divorce.
