Sendika özgürlüğünün güvencesi

Abstract

6356 sayılı Kanunun 25. maddesinin madde başlığını oluşturan “Sendika Özgürlüğünün Güvencesi” ifadesi tezimizin de ismini oluşturmaktadır. Tez konumuz üç bölümden oluşmaktadır. Birinci bölümde, sendika hakkı ve özgürlüğü kavramları ayrıntılı bir biçimde incelenerek ulusal ve uluslararası hukukta sendika özgürlüğünü koruyucu hükümlere yer verilmiş; takip eden ikinci bölümde, sendika özgürlüğünü koruyucu hükümler incelenmiş; son bölümde ise bu koruyucu hükümlere aykırı davranışların hukuki ve cezai yaptırımlarına yer verilmiştir. Tezin gerek hazırlık gerekse yazım süreci içerisinde uygulayıcılar anlamında hakim ve savcılar ile görüşülmüş; öğretideki ve yargı içtihatlarındaki değerlendirmeler çerçevesinde sonuç bölümü ile tezimiz nihayet bulmuştur.

The thesis is given the name of “The Guarentee Of Trade Union Freedom” due to Code 6356. The subject has been reviewed in three different sections. In the first section, the concept of trade union rights and freedoms examined in detail at the national and international law; followed by the second part, examined the freedom of trade unions protective provisions; In the final chapter of place is given to the violation of civil and criminal sanctions that protective provisions. The necessary preparations both in the process of writing a thesis in terms of judges and practitioners have discussed with judge and prosecutors; Our thesis with the results of the evaluation are part of the framework of doctrine and Court of Appeals’ decisions we have finally found it in.
