Abstract
ELEKTRONİK SÖZLEŞMELER TEZ ÖZETİ Elektronik Sözleşmeler başlıklı mden oluşmaktadır. Birinci bölümde internet, elektronik ticaret anahatlarıyla ele alınmış ve elektronik sözleşmelerin tanımı, özellikleri ve çeşitleri incelenmiştir. Tezin ikinci bölümünde ise elektronik sözleşmelerin kurulması ve elektronik sözleşmelerde şekil unsuru detaylı biçimde açıklanmıştır. Elektronik sözleşmelerin şekli açıdan değerlendirilmesi esnasında elektronik imza kurumu ve dijital imza gündeme gelmiş ve bu konuda Türkiye'de ve uluslar arası alanda yapılan kanunlaştırma hareketlerine de değinilmiştir. Yepyeni bir iletişim ağı olan internet, günümüzde elektronik ticaretin büyük bir ivmeyle yaygınlaşmasına imkan hazırlamıştır. Bu sebeple de ortaya çıkmış olan ve çıkabilecek olan hukuki problemlerin çözüme kavuşturulması gerekmektedir. Bu bağlamda, Türk Borçlar Kanununda değişiklikler yapılması ve ayrıca da elektronik imzanın düzenlenmesine dair bir Özel Kanunun da ivedilikle hazırlanması, kanaatimizce uygun olacaktır.
OF THE PH D THESIS WITH SUBJECT ELECTRONIC CONTRACTS Our Thesis with the subject called Electronic Contracts is composed of two sections. In the first section of the Thesis, internet and electronic trade is studied and also the description of the electronic contracts is made and the specialities and the main divisions of electronic contracts are examined. In the second section of the Thesis, we have tried to inspect the foundation of the electronic contracts and the form element of it is examined in details. While we were examining the form element of the electronic contracts, electronic signature notion came on the agenda. We also have tried to point out the legislation efforts both in Turkey and in EU. The internet which is totally a new medium, have created an opportunity for the expansion of electronic trade over the whole world. For this reason the legal problems which have aroused and which will be aroused in the near future, have to be solved. Furthermore, amendments in the Turkish Code of Obligations have to be accomplished and also a new Act which will regulate the Electronic Signatures have necessarily to be made.
