Şeyhülislam Kemal Paşazâde’nin “Şerhu Tağyîri’t-Tenkîh” isimli eserinin “Et-Taksîmü’s-Sânî”ye kadar olan kısmının tahkîki

Abstract

Bu çalışmada 16. Asır Osmanlı ulemasından Şeyhülislam Kemâl Paşazâde’nin (ö. 940/ 1534) usûl-i fıkıh ilmi alanında telif ettiği Şerhu Tağyîri’t-Tenkîh eserinin başlangıcından et-Taksîmu’s-Sânî kısmına kadar olan bölüm tahkik edilmiştir. Kemal Paşazâde’nin söz konusu eseri Ubeydullāh b. Mes‘ûd Sadruşşerîa’nın (ö. 747/ 1346) Tenkīhu’l-Usûl isimli usûl kitabı üzerine telif edilmiş bir eserdir. Çalışmamızın temel konusunu Kemal Paşazâde’nin eserinin tanıtımı ve eserin yukarıda belitilen kısmının tahkiki oluşturmaktadır. Çalışmanın birinci bölümünde Şerhu Tağyîri’t-Tenkîh içerik ve uslüp yönüyle incelenmiş, tahkikte esas alınan nüshaların tanıtımı yapılmıştır; ikinci bölümde ise eserin tahkik edilen bölümü yer almaktadır.

The main subject of this M.A. thesis is the description and a partial critical edition of “Sarh Tagyir at-Tenkih”. The author of the book is the famous Ottoman scholar of sixteenth century Shaykh al-Islâm Kemal Pashazade. It is a commentary on Tankih al-Usul written by Ubeydullāh b. Mes‘ûd Sadrusseria in the field of islamic legal theory, usul al-fiqh. In the first chapter we analyzed the structure of the Kemal Pashazade’s work and his method in commenting on the main text and we also provided the description of the manuscripts used in the critical edition. In the second chapter we gave the critical edition of the manuscript from the beginning to the second part (at-Taksîm as-Sani).
