Publication: Hadisleri değerlendirmedeki farklılıkların fıkha etkileri : Hanefî imamları örneği
Abstract
Bu çalışmada Hanefî mezhebinin kurucusu Ebû Hanîfe (ö. 150/ 767) ile iki öğrencisi Ebû Yûsuf (ö. 182/ 798) ve Muhammed b. el-Hasen eş-Şeybânî (ö. 189/ 805) arasındaki fıkhî ictihad farklılığının sebeplerinden, hadis kaynaklı olanlarını inceleyeceğiz. Bu konuda yalnızca birtakım nazarî/ teorik bilgileri sunmakla yetinmeyecek, aynı zamanda bu nazariyatı ilk dönem kaynakları çerçevesinde örnekler ve somut verilerle desteklemeye çalışacağız. Hadislerdeki ihtilaf gerekçeleri konusunda her üç imamdan gelen bilgiler sınırlı olmakla birlikte elden geldiğince ilk dönem kaynaklarında bulunanları tespit etmeye gayret edeceğiz. Veriler sınırlı olduğu için ihtiyaç oldukça sonraki dönem Hanefî kaynaklarından konuyla alakalı bilgileri de nakledeceğiz.
In the study, we will examine the hadith originated reasons of the differences in fiqh jurisprudence between the founder of the Hanafi Sect, Abu Hanifa and his two students, Abu Yusuf and Muḥammad b. Ḥasan al-Shaybani. We will not only provide some theoretical information in this regard, but we will also try to support these theories with examples and tangible proofs depending on early sources. Although the information from all three imams about the reasons of the disputes in the hadiths is limited, we tried to identify those found in the sources of the first period as much as possible. Since the proofs are limited, we did not neglect to convey relevant information from the later period Hanafi sources when needed.
