Eser sözleşmesi uygulamada en sık karşılaşılan sözleşme tiplerinden biri olup, en fazla uyuşmazlığın yaşandığı sözleşmelerden de biridir. Bu sözleşmede yüklenicinin ediminin şahsiliğinden anlaşılması gerekenin ne olduğu, şahsen ifa borcunun kapsamı, ve özellikle iş sahini, yüklenici, alt yüklenici, yardımcı kişi kavramları çerçevesinde şahsen ifa borcunun ihlalinden doğan sonuçlar bu çalışmada inceleme konusu yapılmıştır.Contract of a Construction is one of the most encountered contract in practice also additionaly it creates numerous conflicts between the parties. In this article, I will address the meaning of a personal performance, the scope of a personal performance, the term of a party ordering work, contractor, subcontractor, subsidiary person and also the remedy of breach of a personal performance obligation.
