Abstract
İSLÂM HUKUKUNDA İDDET VE HÜKÜMLERİ Sözlükte; saymak, sayılan şeyin miktarı, adet anlamına gelen iddet kelimesi, İslâm hukukunda; evliliğin herhangi bir nedenle sona ermesi durumunda kadının yeni bir evlilik yapabilmek için beklemek zorunda olduğu süreyi ifade eder. Bütün toplumlarda bulunan iddet (bekleme süresi) uygulaması, İslâm hukukunda daha geniş olarak ele alınmıştır. Çünkü iddet kavramı, Kur’ân ve hadis kaynaklarında çok ayrıntılı biçimde işlenmiştir. Bu süre, evlenme yasağı, mesken, nafaka, nesep, miras gibi birçok hak ve yükümlülük için ölçü kabul edilmektedir. Bu nedenle konuyla ilgili kapsamlı bir hukuk literatürü oluşmuştur. İddet konusu, fıkıh literatüründe evliliğin sona ermesinin neticelerinden biri olarak “iddet” alt başlığı altında (Bâbu’l-İdde) veya müstakil bir bölüm halinde (Kitâbu’l-idde) işlenmiştir.
IDDA AND IT’S LEGAL RESULTS IN ISLAMIC LAW In dictionary, from word idda, “to count, enumarete, days of menstruation”, Islamic law for “the duration of widowhood or, rather the period of abstention from the sexual relations imposed on a widow or a divorced woman or a woman whose marriage has been annulled, before she may re-marry. The practice of idda (waiting period) which have been in all society is studied in a wider aspect in Islamic law. Because of the term of idda was studied in Kur’an and sources of hadith more detailed. This period is a criterion for banning of marriage, dwelling, maintenance, lineage, estate and other obligations and other rights. Because of, a comprehensive law literature have existed. And this matter is studied in literature of fikh under title of “Bab al-idda” or “Kitab al idda”.
