Yatırım hukuku çerçevesinde üye devletlerin alternatif uyuşmazlık çözüm mekanizması ihdas yetkisi

Abstract

Bu tez Avrupa Birliği Adalet Divanı’nın Achmea kararı özelinde yatırım tahkimi alanında Üye Devletlerin alternatif uyuşmazlık çözüm yöntemleri ihdas yetkisini değerlendirme amacıyla yazılmıştır. Öncelikle bu tezde yatırım tahkiminin AB hukuku açısından niteliği incelenmiştir. İkincil olarak Achmea kararının Üye Devletler ve yatırım tahkimi alanında anlaşma yapılan 3. taraf devletler açısından sonuçları değerlendirilmiştir. Daha sonra Achmea kararı doğrultusunda Komisyonun ve Üye Devletlerin attığı adımlar ele alınmıştır. Bu doğrultuda gelecekte yatırım uyuşmazlıklarının nasıl çözümleneceğine ilişkin değerlendirmeler, altyapısı oluşturulan yeni sistem incelenerek aktarılmıştır.

This thesis seeks to determine Member States authority to establish alternative dispute resolution methods in the field of investment arbitration, specific to the Achmea decision of the European Court of Justice. First of all, in this thesis, the nature of investment arbitration in terms of EU law has been examined. Secondly, the results of the Achmea decision in terms of Member States and third party states in the field of investment arbitration were evaluated. Then, the steps taken by the Commission and the Member States according to the Achmea decision were discussed. In this manner, with the new system, evaluations on how to resolve investment disputes in the future was examined.
