Publication: Türk i̇ş hukukunda işe iade davasının hukuki̇ sonuçları
Abstract
İş Hukukunu temel amaçlarından birisi de, ekonomik olarak zayıf konumda bulunan, çoğu zaman kendisinin ve ailesinin geçimini iş sözleşmesi kapsamında aldığı ücretle sağlayan işçilerin, sözleşmelerinin işverence haksız ve geçersiz bir şekilde feshedilmesinin önlenmesidir. Bu nedenle de, işverenin keyfi feshine engel olunarak, işçi ile işveren arasındaki ilişkinin devamının temini amacıyla, gerek uluslararası gerekse de ulusal düzeyde iş güvencesine ilişkin çeşitli düzenlemeler yapılmıştır. Bu düzenlemeler sonucunda, işçi tarafından, işverenin yaptığı feshin geçersizliğinin tespiti ve işine geri dönebilmek amacıyla yönelik işe iade davası açabilecektir. Bu tez çalışmamızda, Türk İş Hukukunda İşe İade Davasının Hukuki Sonuçları, doktrinde ileri sürülen görüşler, Yargıtay ve Bölge Adliye Mahkemesi kararları ve yasal düzenlemelerde meydana gelen değişiklikler nazara alınarak incelenmiştir. Çalışmamız üç temel bölümden oluşmaktadır. Birinci bölümde, İş Güvencesi Kavramı, Kapsamı ve İş Sözleşmesinin Geçerli Nedenle Feshi hakkında bilgiler verilmiştir. İkinci bölümde, Türk İş Hukukunda İşe İade Davası incelenirken, son bölümde İşe İade Davasının Hukuki Sonuçları hakkında açıklamalara yer verilmiştir.
One of the main objectives of Labor Law is to prevent the unfair and invalid termination of the contracts of workers who are in an economically weak position and who often earn their living with the wages they receive within the scope of the employment contract, by the employer. For this reason, various regulations regarding job security have been made at both international and national levels in order to prevent arbitrary termination by the employer and to ensure the continuation of the relationship between the employee and the employer. As a result of these regulations, the employee may file a reinstatement lawsuit in order to determine the invalidity of the employer's termination and to return to work. In this thesis, the Legal Consequences of the Reinstatement Case in Turkish Labor Law have been examined, taking into account the opinions put forward in the doctrine, the decisions of the Supreme Court and the Regional Court of Justice, and the changes in legal regulations. Our study consists of three basic parts. In the first part, information is given about the Concept and Scope of Job Security and Termination of the Employment Contract with Valid Reason. In the second part, the Reinstatement Case in Turkish Labor Law is examined, while in the last part, explanations are given about the Legal Consequences of the Reinstatement Case.
