Abstract
Çalışmamızın konusunu kripto paralara elkonulması ve kripto paraların müsadere edilmesi oluşturmaktadır. Kripto paralar merkezi birotorite tarafından denetlenmediğinden şüpheli faaliyetlerin tespiti, kullanıcıların kimliğinin belirlenmesi ve işlem kayıtlarının elde edilmesi adlive idari makamların işlerini zorlaştırırken, suç teşkil eden fiilleri işleyenkişilere bu ödeme şekli ve transfer metodu cazip gelmektedir.Kripto paralara elkonulması ve kripto paraların müsaderesi adlimakamlar için hem hukuki belirsizlikleri hem de uygulamaya yönelikzorlukları beraberinde getiren yeni bir mücadele alanıdır. Kripto parabirimlerinin koruma tedbiri olarak elkoyma ve yaptırım olarak uygulanan müsadere için uygun varlıklar olup olmadığı, eğer öyleyse bu işlemlerin nasıl uygulanacağı ve bu kapsamda kripto paraların hukuki niteliği, ceza hukuku ile ilişkisi, hangi suçlara konu olabileceği mevcut düzenlemelerle izah edilecektir.
The subject of our study is the seizure of cryptocurrencies and the confiscation of cryptocurrencies. Cryptocurrencies are not controlled by a central authority, the detection of suspicious activities, identification of users and obtaining transaction records make it difficult for judicial and administrative authorities, while this payment method and transfer method is attractive to those who commit criminal acts. Seizure of cryptocurrencies and confiscation of cryptocurrencies is a new challenge for judicial authorities, which brings both legal uncertainties and practical difficulties. Whether cryptocurrencies are suitable assets for seizure as a protection measure and for confiscation as a sanction, if so, how these transactions will be implemented, and in this context, the legal nature of cryptocurrencies, their relationship with criminal law, and which crimes they may be subject to will be explained by the current regulations.
