Publication: 5149 sayılı sporda şiddet ve düzensizliğin önlenmesine dair kanun çerçevesinde spor güvenliği
Abstract
Çalışmamızda, ülkemizde ve dünyada spor müsabakalarında meydana gelen ve özellikle son yıllarda artış gösteren şiddet ve düzensizlik olayları, dünyadan spor güvenliği mevzuatları ve ülkemizde bu çeşit olayları önlemek üzere çıkartılan “5149 sayılı Spor Müsabakalarında Şiddet ve Düzensizliğin Önlenmesi Hakkında Kanun” çeşitli yönleriyle anlatılmaya çalışılmıştır. Çalışma, esas olarak teorik ve araştırma bölümleri içermektedir. Teorik Bilgiler “ana başlığı altında verilmiştir. altında ilk bölüm olarak öncelikle; “Sporda Şiddet Kavramı” çeşitli görünümleri ve bu şiddetin kaynakları ile güncel örnekler verilerek anlatılmıştır. Daha sonra da ikinci bölüm olarak “Sporda Şiddet ve Hukuksal Tedbirler” başlığı altında mukayeseli hukuka değinilmiş, sırasıyla Avrupa Konseyi belgeleri, Avrupa Birliği belgeleri, FIFA, UEFA gibi uluslararası spor federasyonlarının düzenlemeleri ve İngiltere, İtalya, İspanya gibi önemli Avrupa ülkeleri başta olmak üzere diğer ülkelerin mevzuatlarına değinilmiş, Türk Hukuku’nda bu konuyla ilgili mevzuata genel olarak değinilmiştir. altındaki son ve üçüncü kısımda ise 5149 Sayılı Kanun ilgili kanun çeşitli yönleriyle ve güncel örneklerle genel olarak değerlendirilmeye çalışılmıştır. Burada kanuna ait her madde, maddeye yöneltilen eleştiriler ve uygulamada karşılaşılan zorluklarla teker teker anlatılmaya çalışılmıştır. Çalışmanın son kısmı konuyla ilgili saha araştırmasına ayrılmıştır. Bu bölümde : - 5149 Sayılı Kanun’un yaptırım gücünün yeterli olup olmadığını, - Spordaki şiddet olaylarının devam etmesinin ilgili kanundan mı yoksa uygulamadan mı kaynaklandığını, - Ankete katılanların böyle bir kanunun varlığından haberdar olup olmadıklarını araştırmak üzere Marmara Üniversitesi Beden Eğitim Spor Yüksek Okulu ve yine aynı üniversitenin Hukuk Fakültesi öğrencilerine 17 soruluk bir anket uygulanmıştır. Anketin sonucunda elde edilen bulgular tablolar halinde yüzdelik oranlarla açıklanmaya çalışılmıştır. Araştırmamızın sonucuna göre ise hem kanunun ilgili maddelerinin önleyicilik açısından yeterli olmadığı hem de devam eden şiddet olaylarında problemin 5149 Sayılı Kanunun uygulanmasından kaynaklandığı ve ankete katılanların yarıya yakınının böyle bir kanunun varlığından haberdar olmadıkları sonucuna varılmıştır. Çalışmanın son bölümünde ise kanunun eksiklikleri ve diğer konularla ilgili önerilere yer verilmiştir.
Sports Safety In The Frame of Code Against Violence and Disorder In Sport Competitions No:5149 In this research, violence and disorder events in sport fields which is an increasing object in recent years in Turkey and other countries, also other countries laws about sports security and a code named “Code Against Violence and Disorder In Sport Competitions” which is legalized to prevent violence and disorder in sports competitions in Turkey, is attempted to describe in its several frames. The research mainly contains contains theorical and field study parts. The theorical informations is given with the main title “General Information”. Below the title General Information, first, the subject “Sports Violence” is described with its several appereances and current cases. After that, secondly, below the title “Violence in Sports and Law Measures”, comparative law and Turkish Law are mentioned, in turn, European Council documents, European Union documents, some international sport federations regulations like FIFA, UEFA and other countries regulations including important European countries England, Italy and Spain. Then Turkish Law about this subject is generally mentioned. In the last and the third part of “General Information” title, the code named “Code Against Violence and Disorder In Sport Competitions” is interpreted with its several sides and current cases. Every article of this code is attempted to describe one by one with their imperfections and animadversions in code’s implementation. The last part of research is about Field Study. In this part: - if the code’s power of sanctions are sufficient, - if the violence and disorder events still exist, the problem is causing from the code or its implementation - and if participants have ever heard of this Code In this part, to find the answers of these three questions a survey which contains 17 questions are applied to Marmara University Phsycal Education and Sports High School and same university’s Faculty of Law students. The results of survey is attempted to explain with boards of percentile. As a result, the power of sanctions are described insufficient, the sour of problem depends on implementation and almost half of participants have not heard of this Code. In the last part of reseach some proposals are given about imperfections of code and other subjects.
