Türk borçlar kanunu çerçevesinde kiracının kiralananı özenle kullanma borcu

Abstract

Kiracı kiralananı özenle kullanmak zorundadır. TBK m. 316’da özenle kullanma borcunun kapsamı kiralananı özenli kullanmak, kiralananı sözleşmeye uygun kullanmak ve komşulara saygı göstermek olarak belirlenmiştir. Kiracının özenle kullanma borcuna aykırı davranması halinde kiraya veren kiracıdan kiralananın eski hale getirilmesini veya tazminat isteyebilir. Kiraya veren bunlar dışında kira sözleşmesini feshedebilir. Konut ve çatılı işyeri kiralarında istisnalar hariç olmak üzere kiraya veren sözleşmeyi feshetmeden önce ihtarda bulunmak zorunda iken diğer kira sözleşmelerinde kiracıya ihtarda bulunmadan yazılı olmak şartıyla kira sözleşmesini feshedebilir.

Lessee is obliged to use the leased property with care. The scope of obligation of using the leased property with care in article 316 in Turkish Code of Obligations is, using the leased property in compliance with the contract and respecting neighbors. In case lessee acts contrary to the obligation of using the leased property meticulously, lessor may require the lessee to reinstate the leased property or compensate the damage. Furthermore, lessor may terminate the contract. Beside the exceptions as to the lease of dwelling and roofed workplaces, lessor may terminate the contract without serving a prior notice on lessee, however as to other lease relations, lessor may terminate the contract through a written notification without serving a prior notice on lessee.
