Dijital platformlarda telif hakları ve yazılı eserler için blockchain tabanlı bir telif hakkı modeli

Abstract

İnternetin günlük hayatın her alanına girmesi fikri mülkiyet alanında da köklü değişiklikleryaratmıştır. Dijital medya yazarlara sınırsız üretim ve dağıtım imkânı sunarken, korsanların önünü açmışve onlar için çok daha büyük bir pazar oluşturmuştur.Eser sahibinin haklarını korumanın ve korsanla mücadele etmenin en etkin yollarından birisiesere daha fazla değer katmak ve onu daha cazip hale getirmektir. Bir eserin taşıdığı bilgi yükü ilebirlikte koleksiyon değerine de sahip olması tüketiciyi memnun ederken, eser hırsızlığınızorlaştıracaktır. Korsan endüstrisi içeriği birebir kopyalayarak ücretsiz dağıtabilir, fakat eserin biçimidolayısıyla sunduğu değeri kopyalayamaz.Bu tezde yazılı eserlerin dağıtımında dijital orijinal kavramının uygulanması üzerine bir denemeyapılmıştır. Dijital orijinal kavramının amacı sınırlı sayıda olan, kopyalanamayan ve her biri kendikullanıcısına özgün olan dijital kopyalar yaratmaktır. Dijital kopyalar bu sayede korsan endüstrisindenkorunurken tüketiciye de ilave değer katmaktadırlar. Uygulama kapsamında dijital değerinoluşturulması için blokzincir teknolojisinden ve Ethereum akıllı sözleşmelerinden faydalanılmıştır.Geliştirilen uygulama eser sahibine blokzincir üzerinde kendi eserinin kopyalarını temsil eden dijitalvarlık oluşturma imkânı sağlamaktadır. Dijital varlık aynı zamanda eserin metin dosyasına erişmek içinanahtar görevi görmektedir

Penetration of the Internet into every aspect of daily life has also created radical changes in thefield of intellectual property. While digital media provides unlimited production and distributionpossibilities for authors, it has paved the way for the pirates and created a much bigger market for them.One of the most effective ways to protect the rights of the author and fight against piracy is toadd more value to the work and make it more attractive. The fact that a work has a collection value alongwith the information will make the theft more difficult while satisfying the consumer. The piracyindustry can copy content and distribute it for free but cannot copy the value it offers under the hood.In this thesis, an experiment has been made on the application of the digital original concept inthe distribution of written works. The aim of the concept of digital original is to create digital copiesthat are limited in number, cannot be copied, and each is unique to its user. In this way, digital copiesare protected from the piracy industry and add additional value to the consumer. Within the scope of theapplication, blockchain technology and Ethereum smart contracts were used to create digital value. Thedeveloped application provides the author with the opportunity to create a digital asset that representscopies of his own work on the blockchain. The digital asset also acts as the key to access the text file ofthe work.
