Abstract
İslâm Tarihi boyunca para ve paranın hükümleri Müslümanlar arasında uzun uzadıya tartışılan konulardan birisidir. Bundan dolayı İslâm Hukuku’nda bir bedelin, neye itibarla para olarak değerlendirileceği, bu husustakî temel kriterlerin ne olduğu ve para olarak kabul edildiğinde hangi farklı hükümleri alacağı mühim konulardır.Özellikle günümüzde, klasik kaynaklar döneminde ki para cinslerinden farklı paraların kullanılması ve teknolojinin gelişmesiyle her geçen gün para çeşitlerinin gelişmesi gibi etkenler paranın İslâm Hukuku’na göre hükümlerinin yeniden ve daha tafsilatlı araştırılmasını gerektirmektedir. Günümüzde kullanılan kâğıt paraların durumlarını tespit edip onlar hakkında yorum yapabilmek için klasik kaynaklarımızda geçen para ve para cinsleri ile alakalı ahkâmın ayrıntılı şekilde tahlil edilip, değerlendirilmesi gerektiği kanaatindeyiz. Bundan dolayı bu çalışmada günümüz paralarına benzediğine kanaat getirdiğimiz fels paraların hükümlerine ayrıntılı şekilde yer verilecektir. Fels paraların hükümlerinden bahsederken felsleri, altın ve gümüş paralara kıyaslayarak farklı oldukları hükümler tespit edilmeye çalışılacaktır. Sonuç olarak günümüz paralarının hüküm cihetinden altın ve gümüş cinsi paralara benzemediği, fels paralara benzediği ve ona göre hüküm alması gerektiği görüşü incelenmeye çalışılacaktır
PROVISIONS OF MONEY TYPES OUTSIDE OF GOLD AND SILVER MONEY IN HANAFI SCHOOLMoney and its provisions are one of the issues that has been discussed at length among Muslims throughout the history of Islam. Therefore, issues such as in what way a value in Islamic Law will be evaluated as Money, what are the basic criteria in this matter and which provisions will be different when it is accepted as money are important issues.Especially today, factors such as the use of different currencies than the currencies in the period of classical resources and the development of currency types with the development of technology, requires the provisions of money according to Islamic Law to be investigated again and in more detailed. We are of the opinion that in order to determine the provisions of paper money used today and to be able to comment on them, the provisions related to money and currency types in our classical sources should be analyzed and evaluated in detail.Therefore, in this study, the provisions of fels coins, which we believe to be similar to today's money, will be given in detail. While talking about the provisions of fels coins, by comparing fels to gold and silver coins, it will be tried to identify different provisions between them.Consequently, the view that today's currencies do not resemble gold and silver coins in terms of rule, they are similar to fels coins and should be judged accordingly will be studied.
