Abstract
zmet Kusuru, Kusursuz Sorumluluk, Sosyal Risk İlkesi, Nedensellik Bağı, Terör Eylemleri ÖZET TERÖR EYLEMLERİNDEN DOLAYI İDARENİN SORUMLULUĞU Bu tez, idarenin, terör eylemleri sonucu meydana gelen zararlardan sorumlu olup olmayacağını, idare bu faaliyetlerden ve eylemlerden sorumlu olacaksa bu sorumluluğunun niteliğini ve nasıl belirleneceğini açıklamayı amaçlamıştır. Çalışma, “idarenin sorumluluk esasları” ve “terör eylemlerinden kaynaklanan zararların karşılanması için iç hukukta başvurulacak hukuki yollar” olarak iki ana bölümden oluşmaktadır. İlk bölümde, genel olarak sorumluluk, sorumluluk çeşitleri, idari sorumluluk, idari sorumluluğun Türk hukukundaki tarihsel gelişimi, idarenin sorumluluk çeşitleri olan hizmet kusuru ve kusursuz sorumluluk, idari sorumluluğun şartları, terör eylemleri sonucunda ortaya çıkan zararların tazmininde idarenin kusur sorumluluğu ile sosyal risk ilkesi ve hangi durumlarda idarenin sorumluluğunun tamamen veya kısmen kalkacağı konuları incelenmiştir. Çalışmanın ikinci bölümünde ise terör eylemlerinden kaynaklanan zararların tazmini için iç hukukta başvurulacak hukuki yollar olan tam yargı davaları ve 5233 sayılı Terör ve Terörle Mücadeleden Doğan Zararların Karşılanması Hakkında Kanun ve bu Kanun’a göre başvuru yolu konuları ele alınmıştır. Son olarak, 5233 sayılı Kanun’un hazırlanma süreci, amacı, kapsamı, Kanun kapsamında yapılacak başvuruların süresi, şekli, sonuçlandırılması, karşılanacak zararlar, bu zararların tespiti ve zararların karşılanmasına ilişkin sulhname konuları açıklanmıştır. Bu bağlamda, Danıştay ve Askeri Yüksek İdare Mahkemesi kararlarına ve terör eylemlerinden doğan zararlarla ilgili yapılan başvurulara ilişkin örnek niteliğindeki Avrupa İnsan Hakları Mahkemesi kararlarına da yer verilmiştir. THE RESPONSIBILITY OF ADMINSTRATION DUE TO TERROR ACTS This thesis is aimed to explain whether the administration is liable for damages occur from terror acts and if the administration is liable what is the nature of this responsibility and how to determine the liability. This book is consists of two main parts: “the liability principles of administration” and “domestic legal remedies to meet one’s lose in case of terror acts”. The first chapter, in general, focuses on “responsibility, varieties of accountability, the responsibility of administration, historical development process of the responsibility of administration, failure of service and irreproachable responsibility as types of administrative responsibility, accountability requirements, defect liability and social risk in case of compensating losses resulting from Terrorist Acts and in what cases disappearance of liability and reduction of liability can occur.” The second part of the study focuses on “unlimited jurisdiction cases” and No. 5233 Law on “Compensation of Losses Resulting from Terror and Fight against Terror” and legal remedies according to this law as national legal remedies in order to compensate losses resulting from terrorist acts. Finally, following subject matters are explained; the Law No. 5233 making process, ratio legis and scope of this law, application time within the scope of Law No. 5233, form, result, coverable damage, determination of damage and negotiated settlement with regard to damage. In this context, the study is supported by the State Council’s and the Supreme Military Administrative Court’s decisions and the European Court of Human Rights’ exemplary decisions related to the exposure arising from Terror acts.
