6360 SAYILI KANUN'A İLİŞKİN LİTERATÜR TARAMASI

Abstract

12 Kasım 2012de kabul edilen 6360 Sayılı Kanun idari, siyasi, mali ve anayasal olmak üzere çok boyutlu bir zeminde tartışma alanı yaratmış, Türkiyenin idari yapısında gerçekleşen hızlı ve önemli bir dönüşüm sürecine tanık olunmuştur. Kanunun getirdiği değişimi değerlendiren çalışmaların incelenmesi bu çalışmanın konusunu oluşturmuştur. Literatür taraması yöntemiyle belirlenen akademik, kurumsal ve yargı alanındaki çalışmalar çerçevesinde, tasarı sürecinden bugüne kadar Kanuna yöneltilen hem olumlu hem de olumsuz değerlendirmelerin objektif ve kapsamlı bir şekilde analiz edilmesi hedeflenmiştir. Akademik yazında Kanunun genellikle ölçek, hizmet, katılım ve mali konular kapsamında değerlendirildiği görülmüştür.

Act no 6360 dated 12 November 2012 caused multiple debates on administrative, political, financial and constitutional grounds. A fast and significant transformation took place in the administrative structure of Turkey. The aim of this study is to review the literature about this transformation process that was brought about by the law. Within the frame of academic papers, institutional documents, and legal studies, we objectively analyze both negative and positive assessments about the law since its drafting process until today. It was found that topics about scale, service, participation, and financial issues have been the most frequently studied topics in academic papers.
