Abstract

Kentsel dönüşüm uygulamaları kapsamında arsa payı karşılığı inşaat sözleşmeleri Çalışmamızda kentsel dönüşüm uygulamaları kapsamında yeni yapı inşası amacıyla arsa malikleri ile müteahhit (yüklenici) arasında akdedilen arsa payı karşılığı inşaat sözleşmelerinin; öncesi, düzenlenme aşaması ve sözleşme sonrası süreçler ve bu süreçlerde taraflar arasında meydana gelen sorunlar incelenmiştir. Bu kapsamda öncelikle kentsel dönüşüm uygulamalarından afet riski altındaki alanlarda bulunan konutların dönüştürülmesi ile alakalı süreçler incelenmiş devamında arsa payı karşılığı inşaat sözleşmesinin detaylarına ve tanımına ehemmiyet verilmiştir. Son aşamada ise bu iki başlık birlikte incelenerek kentsel dönüşüm uygulama süreçlerinde arsa payı karşılığı inşaat sözleşmesinin kullanımı ile sözleşmeler kapsamında ortaya çıkan problemler ve bunların çözümlerine dair öneriler dile getirilmiştir.

Land share-based construction contracts in the context of urban renewal projects This study examines land share construction contracts concluded between landowners and contractors (developers) for the construction of new buildings within the scope of urban transformation practices. The analysis is structured around the pre-contractual phase, the contractual formation process, and the post-contractual period, focusing on the disputes arising between the parties at each stage. Initially, the study explores the transformation processes of residential buildings located in areas under disaster risk, as regulated within urban transformation practices. Subsequently, the definition and legal characteristics of land share construction contracts are addressed in detail. In the final section, the study evaluates the interplay between urban transformation procedures and land share construction contracts, identifying common problems encountered during their implementation and offering potential legal and practical solutions to these issues.
