Hukuk devleti perspektifinden yargıda yapay zekâ uygulamaları

Abstract

Bu tez, yapay zekâ teknolojilerinin yargı sistemine entegrasyonunu hukuk devleti ilkesi çerçevesinde değerlendirmektedir Hukuk devleti, insanın keyfî yönetimi yerine hukukun hâkim olduğu adil ve objektif bir düzeni ifade eder Bu düzenin tesisi, hukukun şekli ve maddi ilkeleriyle birlikte, uygulamada insan failliğine dayanan bir işleyişi öngörür Zira hukuk kurallarının vakıaya etkisi, normatif yapıyı anlamlandıran ve uygulayan insan özne aracılığıyla gerçekleşir Hukuk devleti anlayışı sübjektifliğin doğası gereği insan failliğinin ayrılmaz bir parçası olduğunu kabul eder Bunu kural temelli muhakeme, usuli adalet ve gerekçelendirme ilkeleriyle dengeleyerek hem hukukun objektifliğini vakıalara yansıtır hem de yargılamanın insan odaklı kurgusunu muhafaza eder Yapay zekâ uygulamalarının gelişimi, insan failliğine dayanan bu yerleşik işleyişin sorgulanmasına neden olmaktadır Çalışmada, yapay zekânın objektiflik, tarafsızlık ve verimlilik gibi yönlerden yargı mekanizmasının işleyişine katkı sağlayabileceği kabul edilmekle birlikte, hukuk devletinin maddi kavramsallaştırmasını benimseyen anayasal bir düzende hukuki muhakemenin ve normatif değerlendirme sürecinin esasını oluşturan insan yargısının algoritmik sistemlerle ikame edilemeyeceği ortaya konulmuştur

This thesis examines the integration of artificial intelligence technologies into the judicial system within the framework of the rule of law The rule of law denotes a fair and objective order governed by legal norms rather than arbitrary human authority Realizing this ideal requires not only adherence to formal and substantive principles of legality but also a functioning legal order grounded in human agency Legal norms acquire relevance in concrete cases through the interpretive and applicative acts of human subjects The concept of the rule of law recognizes the inescapability of subjectivity inherent in human agency and seeks to reconcile it with the demands of objectivity through principles such as rule-based reasoning, procedural fairness, equity and well-founded verdicts In this way, it maintains both the normative coherence of law and the human-centered character of adjudication The increasing use of AI technologies within the judiciary challenges this established structure based on human agency While the thesis acknowledges the potential contributions of AI to objectivity, impartiality, and efficiency in judicial processes, it argues that within a constitutional order committed to a substantive conception of the rule of law, the evaluative and interpretive functions at the core of legal reasoning cannot be fully replaced by algorithmic systems
