Türk Anayasa Mahkemesi kararlarında kamulaştırma

Abstract

Kamulaştırmanın mülkiyet hakkı ile olan ilişkisi ve anayasada düzenlenen bir müessese olması bu işlemin anayasa hukuku açısından ele alınmasını gerekli kılmıştır. Çalışmamız iki bölümden oluşmaktadır. İlk bölümde kamulaştırmanın tarihsel süreçteki gelişimi ve kamulaştırmanın idari aşamaları ele alınmıştır. İkinci bölümde ise kamulaştırmanın mülkiyet hakkı ile olan ilişkisi ve Anayasa Mahkemesi kararlarında kamulaştırmanın ele alınış şekli incelenmiştir. Bu çalışma ile kamulaştırmanın Türkiye’de geçirdiği dönüşüm ve bu dönüşümün Türk Anayasa Mahkemesi kararlarına ne şekilde yansıdığının incelenmesi amaçlanmıştır. Anayasa Mahkemesi kararlarının incelenmesi örnek kararlara yer verilerek açıklanmaya çalışılmıştır.

The relation between expropriation and proprietary righs, and the fact that expropriation is regulated within the constitution make it necessary to approach this procedure within the field of the constitutional law. This study consists of two sections. In the first section, historical development of expropriation in Turkey and its administrative stages are discussed. İn the second section, the relation between expropriation and proprietary rights and the manner in which the expropriation is handled in the decisions of the constitutional court are examined. This study aims to examine the transformation of expropriation in Turkey and how this transformation is reflected in the decsions of the Turkish Constitutional Court. Morever, the examination of the decisions of the constitutional court has been tried to be explained by giving precedent decisions as examples.
