Abstract
Manisanın Soma ilçesinde faaliyet gösteren Eynez maden ocağı iş letmesinde 13.05.2014 tarihinde iş kazası meydana gelmiş ti. Belirtilen maden ocağındaki faaliyet (iş ), Çalış ma ve Sosyal Güvenlik Bakanlığı tarafından 6331 sayılı Kanunun m. 25/I hükmü uyarınca çalış anlar için hayati tehlike oluş turan hususlar tespit edildiğinden durdurulmuş tur. Böylece maden ocağından geçimini sağlayan iş çiler çalış amadığı için gelir kaybına uğramış tır. Ayrıca, aynı bölgedeki Atabacası ve Iş ıklar maden ocaklarında da aynı gerekçelerle iş in durdurulmasına karar verildiği bilinmektedir. Sözü edilen uygulamalar nedeniyle, faaliyetin durdurulduğu dönemde belirli bir süre için, daha sonra iş verenden alınmak üzere devlet tarafından iş çilere belirli miktarda ödeme yapılmasına yönelik yeni düzenlemeler getirilmektedir. Ayrıca, Soma olayında hayatta kalanlara ve ölenlerin hak sahiplerine karş ılıksız olarak belirli bir süre ve belirli bir miktarda ödeme yapılması yönünde yeni düzenlemeler de yapılmış tır. Belirtilen düzenlemeler ilk bakış ta yerinde görülmekle birlikte, bu tür düzenlemelerin olaya özgü değil, genel nitelikli olması ve benzer tüm olaylarda uygulanacak ş ekilde yeniden düzenlenmesi gerekmektedir.
It happened on May 13, 2014, in the Eynez mine enterprise, working in the town of Soma, Manisa. The Ministry of Labour, and Social Security suspended the work in the aforementioned mine, based on findings of life threatening risks to the workers, which falls under article 25/1 of the 6331 numbered Law. Thus, the workers who make their living from this mine, lost their income as a result of not being able to work. Moreover, we know that the work has also been suspended, for the same reasons, in the Atabacası, and Işıklar mines located on the same region. Due to these adjustments, new regulations are issued. According to these regulations, during the suspension period, the Government would pay a certain amount of money to the workers, which would be reimbursed by the Employer at a future date. Moreover, new regulations have also been issued to make certain amount of gratuitous payments for a certain period of time, to the survivors, and the beneficiaries of the deceased. Initially, these regulations may seem expedient; however, these type of regulations should not be tailored to a specific incident; they have to be reissued anew with an eye to general qualifications, which may be applied in all similar incidents.
