Abstract

19. yüzyılda Osmanlı İmparatorluğu ve Batı arasındaki siyasi-ekonomik ilişkiler yoğunlaşırken, bürokratik görevdeki pek çok kişi çeşitli nedenlerle Avrupa’yı ziyaret etme, orada bir süre yaşama ya da eğitim görme olanağını bulmuşlardı. Özellikle yüksek diplomasi çalışanları, Batı siyasi düşüncesinin temel kavramlarını, Osmanlı kültür dünyasına taşıyan kanallardan biridir.Bu çalışmada; Kâni Paşa-zȃde Rif’at Bey’in, M. P. Pradier Fodéré’nin Principes généraux de droit de Politique et de Legislation (Paris,1869) adlı eserini, “Hukûk-ı Umûmiyye” başlığı ile Osmanlı Türkçesine çevirdiği kitabı incelenmiştir. Henüz Darülfünun Hukuk Mektebinde, bir ders olarak müfredata girmeden önce, Osmanlı Türkçesinde Kamu Hukuku ve “Genel Kamu Hukuku” adından bahseden kitap, bu kavramları “nakletmesi” ve dersin içeriği ile ilgili bilgi vermesi bakımından önemlidir.

In 19th century, while the political and economical relationships with the West were intensifying, many people in bureaucratic positions had found the opportunity to visit Europe, and to live or to study there for a while for various reasons. Especially high diplomatic officials were one of the main channels that transfer the basic concepts of Western political thought to Ottoman cultural environment._x000D_ In this study, Kâni Pasha-zȃde Rif’at Bey’s translation into Ottoman Turkish of M. P. Pradier Fodéré’s Principes généraux de droit de Politique et de Legislation (Paris, 1869) under the title of “Hukûk-ı Umûmiyye” is examined. Before entering the curriculum as a course at Darülfunun Law School, the book, which refers to Public Law and “General Public Law” in Ottoman Turkish, is important in terms of “transferring” these concepts and providing information about the content of the course.
