dc.description.abstractGayrimenkul satis vaadi sözlesmesi ile taraflardan biri ya da her ikisi bir bedel karsiliginda gayrimenkul satimi sözlesmesini yapmayi taahhüt eder veya ederler. Kanunlarimiz, uygulama ve baskin görüs, satis vaadinin satim sözlesmesinin kendisi olmayip, onun bir ön sözlesmesi oldugu yönündedir. Taraflar, Tapu Daireleri' nin satim sözlesmesi ile tescili ayni anda yapmalarindan ötürü, hemen tapuda tescilin yapilamayacagi bazi satim sözlesmelerini tapuda yapamamaktadirlar. Bunun disinda, tapuda sözlesme yapmalarinda bir sakinca yokken de satis vaadini seçmis olabilirler. Gayrimenkul satis vaadi sözlesmeleri, taraflar arasinda borç doguran sözlesmelerdendir ve bu sözlesmeden dogan satin alma hakki, ilgili oldugu gayrimenkulün tapu siciline serh edilebilir. Serh, bu hakkin sonraki maliklere karsi kullanilabilmesi imkanini sagladi gibi, sahsi haklarin serhindeki munzam tesiri de saglar. Gayrimenkul satis vaadi sözlesmesinde, karsilikli ve birbirine uygun olarak birlesen iradelerin gayrimenkulü ve satis bedelini içermesi ve sözlesmenin resmi sekilde yapilmasi gerekir. Resmi sekil ispat araci degil, geçerlilik sartidir. Sekil sartina uyulmadan yapilan geçersiz gayrimenkul satis vaadine dayanarak gayrimenkul aliciya teslim edilmis ise, satici istihkak davasi ile gayrimenkulü; alici da sebepsiz iktisap davasi ile ödedigi bedeli isteyebilir. Sekle iliskin hükümden, hükmün amaci disinda yararlanilmaya çalisildigi hallerde, butlan ileri sürme hakki kötüye kullanilmis olur. Gayrimenkul satis vaadi sözlesmesinin ifasi, taraflarin satim sözlesmelerini yapmalaridir. Saticinin sözlesmenin ifasindan kaçinmasi nedeni ile, gayrimenkul satis vaadi sözlesmesinin ifasi için açilacak davada verilecek hüküm, satim sözlesmesinin yerini tutar. Alacakli ayni davada bu satim sözlesmesine dayanarak gayrimenkulün tapu kaydinin iptali ile adina tescilini talep edebilir. Bu sözlesmeden dogan talep ve dava hakki on yilda zamanasimina ugrar.
dc.description.abstractBy immovable property selling promise agreement and related contract both parties or at least one of these parts accept / accepts that they agree on selling immovable property and undertake/ undertakes regarding responsibilities. According to the dominant points of view in the connection of our laws, selling promise agreement, is not the body of selling agreement, but a kind of pre-agreement on selling contract. Due to title deed offices prepare selling contract and registries at the same time, parts of contract can not complete some of selling contracts which are not able to been registered in title deed immidiately. Besides when there is no obstacle about implementation of seelling contract in title deed offices, they could have choosen selling promise process for immovable properties. Immovable properties selling promise agreements, are contracts which create dept relations between parts. By the way the buying right as a cause of this agreement, can be annotated and commented on title deed registration of related immovable property. This explanation and commentary on the registration, gives the right to use this authority against next owners of properties and provides appended additional effect of commentaries of personal rights. In immovable property selling promise contracts, mutually and harmonically connected wills must contain the property and selling amount of it and besides the contract must be implemented by an official way, Official form is not a mean of proving, validity is inevitable. Without obeying the condition and obligation of form, as a result if the property to handed over buyer; at this situation seller by deserving-merit lawsuit can claim the property; and buyer by non-caused deserving-merit lawsuit can claim his amount paid for seller. If one tries to misuse a judgement about a formal situation dismissing the main aim and purpose of this judgement; at this circumstances the right to claim invalidity and nullity is abused. Achieveing immovable property selling promise contract, is both parties' complementation and agreement on this process. As a result if seller disobeys to perform and achieve this agreement, the judgement which will be given after related lawsuit for execution of selling promise contract will substitude for selling contract. Creditor at the same lawsuit as a basis can claim for cancelling the title deed registration of the immovable property. The time limit for right that this agreement breeded and the right for taking lawsuit is ten years.
