Telif Hukuku ve Haksız Rekabet Hukuku Çerçevesinde Eser Adlarının_x000D_ Korunması

Abstract

Fikir ve sanat eserleri genellikle bir ad altında umuma arz edilirler. Eserin adını belirleme yetkisi esersahibine aittir. Eser sahibinin izni olmadıkça eser adında kısaltmalar, eklemeler veya başkaca değişiklikleryapılamaz.Eser adları, eser sahibinin hususiyetini taşıması halinde, eserin bütününden bağımsız olarak; bir edebi esergibi korunabilir. Eser sahibi, bu nitelikteki eser adlarını bağımsız bir hak konusu haline getirebilir ve bunlarüzerindeki hakların ihlali halinde FSEK m. 66 ve devamında düzenlenen talepleri ileri sürebilir.Eser adları, haksız rekabet hükümleri kapsamında da korunmaktadır. FSEK m. 83’e göre, bir eser adınınkarıştırılmaya neden olabilecek şekilde bir başka eserde kullanılması haksız rekabet teşkil eder. Ancak bireser adının bu kapsamda korunabilmesi için ayırt edici nitelikte olması ve umumen kullanılan adlardanolmaması gerekir.Intellectual and artistic works are usually presented to the public under a name. The authority to determine_x000D_ the name of the work belongs to the author. No abbreviations, additions or other changes may be made to_x000D_ the name of the work without the permission of the author._x000D_ If the works’ title is original, such title may be protected like a literary work. The author may claim a_x000D_ legal protection for such titles as a right independent from the work itself and, the author may claim legal_x000D_ remedies set out in Article 66 in case of violation of the rights on such titles._x000D_ The titles of the works are also protected under unfair competition provisions. According to article 83 of the_x000D_ Law on Intellectual and Artistic Works, the use of the name of a work in another work in a way that may_x000D_ cause confusion constitutes unfair competition. However, in order for a work title to be protected in this_x000D_ context; it must be distinctive and it should not be one of the commonly used names.
