Ebu'l-Huseyn el-Kudûrî'nin et-Tecrîd adlı eseri çerçevesinde Hanefî fıkıh usulü'nde şer'î deliller (başlangıcından Kitabu'rRehn'e kadar)

Abstract

Bu çalışma, hicrî V. Asırda Bağdat’ta yaşamış Hanefî fakihi Ebu’l-Huseyn el-Kudûrî’nin et-Tecrîd adlı eseri çerçevesinde Hanefî fıkıh usulünde şer‘î delilleri tespit etmek amacıyla yapılmıştır. Kudûrî, et-Tecrîd adlı eserinde Hanefî fıkıh usulünde, hüküm istinbatında yararlanılan Kitab, sünnet, icma, sahabe kavli, kıyas, istihsan, önceki şeriatler, örf, ıstıshab, maslahat ve ihtiyata yer vermiştir. Araştırma, giriş ve dört bölümden oluşmaktadır. Bu çalışmayla hem usul ile füru arasındaki ilişki, fer‘î meselelerden örneklerle ortaya konmuş hem de Cessâs sonrasında Irak’taki Hanefî fıkıh usulünün gelişimi gözlemlenmeye çalışılmıştır.

This study is carried out in order to determine the shari'a evidences (şer’i delil) in the Hanafi legal theory in the frame of the Hanafi scholar Abu'l-Husayn al-Qudûrî, who lived in Baghdad in the Hijri V. century. Qudûrî, in his book et-Tajreed, included Kitab, sunnah, ijma‘, words of sahaba, analogy (qiyas), istihsan, previous sharia (shar’u man kablana), customs, ıstıshab, maslaha and caution (ihtiyat) which were used to make rules in the Hanafi legal theory. Our study consists of five parts, being an introduction and four chapters. In this study, the relation between the theoretical law (usûl) and the practical law (furu‘) was put forward with examples from the secondary matters (fer’i meseleler) and also the development of the Hanafî legal theory in Iraq after Cessâs was tried to be observed.
