Abstract
HANEFİ VE CAFERİ MEZHEPLERİNDE KADINLARIN NAFAKASI Fıkıh kitaplarında önemli bölümlerden biri “Nikah” bölümüdür. Bunun da önemli kısımlarından biri “Nafaka”dır. Tezimiz “HANEFİ VE CAFERİ MEZHEPLERİNDE KADINLARIN NAFAKASI” başlığını taşımaktadır. Burada kadınların nafakası denildiğinde evlilikte eş olan kadınlar kastedilmiş, nafakaları ele alınmış, eşlerle ilgili hükümlere bakılmış ve bunlarla ilgili açıklamalar yapılmaya çalışılmıştır. Tezimizde Hanefi ve Caferi mezheplerinde Şemsü’l-eimme Serahsi’nin ve Şeyhu’t-taife Ebu Cafer et-Tusi’nin Mebsut kitaplarında eşlerin nafakaları ile ilgili bölümler incelenmiştir. Bu çalışma giriş ve iki bölümden oluşmaktadır. Giriş kısmında araştırmanın önemi, amacı, yöntem ve kaynaklarla ilgili meseleler ele alınmış, nafaka hakkında kısaca bilgi verildikten sonra İmam Serahsi (ö. 483/ 1090) ve Ebu Cafer et-Tusi’nin (ö. 460/ 1067) hayatı, eserleri, hocaları ve öğrencileri hakkında malumat verilmiştir. Birinci bölümde İmam Serahsi’nin Mebsut eserinde eşlerin nafakaları, ikinci bölümde ise Ebu Cafer et-Tusi’nin Mebsut eserine göre eşlerin nafakaları ile ilgili hükümler araştırılmaya çalışılmıştır. MAINTENANCE OF THE WOMEN IN HANAFI AND JAFARI SCHOOLS OF LAW One of the important chapter of Islamic Law is matters of “marriage” and it has several subdivisions that “Alimony”-“Nafaga” one of them. The thesis was wrote on the topic “MAINTENANCE OF THE WOMEN IN HANAFI AND JAFARI SCHOOLS OF LAW”. Our aim in this disquisition to inquire the status of spouses and Islamic rules about “nafaga”. We analyzed in this study condition and chapters of alimony according to Serakhsi and Jafar at-Tusi’s books of “Mabsoot” from Hanafi and Jafari schools. This study consists of an introduction and two chapter. In the introductory part we gave general information about importance of topic, aim, methods, bibliographies and brief information about alimony. After this information we gave briefly analyze biography, works, masters and disciples of Imam Serakhsi (d. 483/ 1090) and Jafar at-Tusi (d. 460/ 1067). The first and the second chapters analyze the conditions of alimony about spouses in the books of “Mabsoot” accordingly Imam Serakhsi's and Jafar at-Tusi's.
