El-Mâverdî’nin el-Hâvî’l-Kebîr adlı eserindeki Ebû Hanîfe’ye nispet edilen görüşlerin tahkiki (ibadetler bölümü)

Abstract

Bu çalışmada, Şâfiî fakihi Mâverdî’nin telif ettiği ve İslam hukuku alanında önemli kaynaklar arasında yer alan el-Hâvi’l-kebîr adlı eserin ibadet bölümünde Ebû Hanîfe'ye nispet edilen görüşlerin Hanefî mezhebi kaynaklarıyla karşılaştırılarak tahkiki amaçlanmıştır. Eser mukayeseli İslam hukuku alanında önemli bir yere sahiptir. Mukayeseli fıkıh üzerine telif edilen eserlerde diğer mezheplere ait muhalif görüşler müellifler tarafından bazen ilgili mezhepte tercih edilen görüşe veya hükme uygun olmayan bir şekilde aktarılır. Bu tür eserlerde bir meseleye ait mezhep görüşünün tam olarak aktarılmaması farklı nedenlerden kaynaklanmış olabilir. Bu çalışmada el-Hâvi’l-kebîr’i bu açıdan incelemeyi amaçladık ve ibadet konularını çerçevesinde Ebû Hanîfe’ye nispet edilen görüşleri tahkik etmeye çalıştık. Çalışma giriş ve sonuç kısmı dışında üç ana bölümden oluşmaktadır. Çalışmanın giriş kısmında araştırmanın konusu, amacı, çalışmada kullanılan temel kaynaklar ve çalışma boyunca tatbik edilen yöntemden bahsedilmiştir. Çalışmanın birinci bölümünde öncelikle Mâverdî’nin hayatı, kendisinden ilim aldığı ileri gelen hocaları, öğrencileri, kaleme aldığı eserleri, şahsiyeti, genel olarak fıkıh metodu ve görüşlerinden örnekler incelenmiş ardından çalışmamıza konu olan eseri tanıtılmıştır. İkinci bölümde, eserin ibadet bölümleri ile sınırlı olmak üzere el-Hâvî’de Ebû Hanîfe'ye nispet edilen görüşler incelemeye tabi tutulmuş, Hanefî mezhebi kaynaklarına müracaat edilerek bu bilgilerin doğruluğu tespit edilmeye çalışılmıştır. Üçüncü bölümde ise incelenen meseleler kapsamında Hanefî mezhebinin tercih edilen görüşüyle bağdaşmayan nakiller analiz edilmiştir. Sonuç bölümünde çalışmada ulaşılan sonuçlar özetlenmiştir.

In this study, I analyzed the views attributed to Abu Hanifa in the sections on worship in al-Ḥawi al-kabir, a work authored by the Shafi'i jurist al-Mawardi, who was born in Basra and whose work is considered one of the important sources in the field of Islamic law. The work holds a significant place in the field of comparative Islamic jurisprudence. In similar works, opposing views belonging to other schools of thought are sometimes cited erroneously. Similarly, the inaccurate references to a different school's view on a particular issue in these works encouraged us to undertake this study. The study is composed of three sections. The introduction discusses the subject of the research, the objectives it aims to achieve, the primary sources used in the study, and the methodology applied throughout the research. The first section examines the life of al-Mawardi, the prominent scholars from whom he received his education, his students, the works he authored, his biography, outlines of his jurisprudential method, and examples from his views; it also introduces the work, the subject of our study. The second section is limited to the examination of the views attributed to Abu Hanifa in the sections on worship within the work. The accuracy of these views is verified by consulting the sources of the Hanafi school. In the third section, the references that do not align with the preferred views of the Hanafi school, within the scope of the issues examined, is analyzed. The conclusion summarizes the findings reached in the study.
