İdari Yargıda İstinaf Kanun Yolu Üzerine Bir Değerlendirme

Abstract

28 Haziran 2014 tarihinde Resmi Gazete'de yayımlanan 6545 sayılı Kanunla kabul edilen idari yargıda istinaf kanun yolu 20 Temmuz 2016 tarihinde uygulanmaya başlanmıştır. Ancak, 6545 sayılı Kanundaki bir takım çelişkiler, eksik düzenlemeler henüz yeni başlayan uygulamada bir takım sorunlara sebep olacak görünmektedir. Çalışmamızda bu sorunlara değinilmiş ve çözüm önerileri sunulmuştur. Diğer bir yandan, çalışmamızda istinaf sisteminin özellikleri yorumlanmış ve uygulamaya yardımcı olabileceğine inanılan düşüncelere yer verilmiştir

Law no. 6545, adopted the administrative court of appeal, published 28 June 2014 in the Official Gazette, come into force 20 July 2016.
