Elektronik sözleşmelerde ifa ve satıcının elektronik sözleşmelerdeki ve diğer sözleşme türlerindeki ayıptan sorumluluğu

Abstract

ÖZETBu tez çalışmasında, satım sözleşmesi temel alınarak elektronik sözleşmelerde ifa ve satıcının ayıptan sorumluluğu hususları incelenmiştir. Sözleşme konusu malın maddi ve gayri maddi nitelikte olması hali gerek sözleşmenin ifa aşaması gerekse de sözleşme konusu malın ayıplı çıkması halinde ayıptan doğan sorumluluğun kapsamı açısından ayrı ayrı değerlendirilmiştir. Çalışma, 6098 sayılı Türk Borçlar Kanunu ile Milletlerarası Mal Satımına İlişkin Sözleşmeler Hakkında Birleşmiş Milletler Antlaşması (CISG) hükümleri temelinde kıyaslamalar yapılarak hazırlanmıştır.

In this thesis fulfillment of electronic agreements and seller’s responsibility for defected goods, based on sales contract are examined. The subjects of the agreement are seperately evaluated about liability for defected good, whether if its tangible or not, during or after the fulfillment of agreement. The study has been prepared by making comparisons based on the provisions of the Turkish Code of Obligations No. 6098 and the United Nations Agreement on Contracts for the International Sale of Goods.
