Piyasa -sosyal koruma ekseninde Avrupa Birliği sosyal politikası ve Türkiye’nin uyumu

Abstract

Bu çalışma, sosyal politikanın serbest piyasa ile sosyal koruma arasındaki gerilim tarafından yönlendirilen “çift yönlü bir hareket” olduğu varsayımına dayalıdır. Karl Polanyi’nin teorik çerçevesinden esinlenen çalışmanın birinci bölümünde, sosyal refah devletlerinin özelliklerinin bu gerilim tarafından belirlendiği savunulmaktadır. Birinci bölümde, iki yüzyıllık bir dönemde oluşan ve iki dünya savaşından sonra da varlığını sürdüren sosyal refah devletinin çöktüğü iddialarına karşı çıkılmakta ve tersine sosyal refah harcamalarının artmakta olduğunu vurgulamaktadır. İkinci bölümde AB sosyal politikasının gelişimi ve sorunları ele alınmaktadır. Bu bölümde, AB sosyal politikasının önemsiz olduğu görüşleri eleştirilmekte ve AB sosyal politikasının önemli olduğu, ancak sosyal politikanın doğasından kaynaklanan nedenlerle düz olmayan bir çizgide geliştiği vurgulanmaktadır. Küreselleşmenin yarattığı meydan okumalar ulusal ölçekli çözümlerden daha çık ulus üstü çözümleri gerektirmektedir. Bu nedenle AB sosyal modelinin varlığını sürdürebilmesi sadece AB ülkelerindeki ücretliler için değil, diğer ülkelerdeki ücretlilerin korunması için de yaşamsal bir rol oynayabilir. Son bölüm Türkiye’nin sosyal politikasının kendine özgü yanlarını ve AB müktesebatı ile Kopenhag kriterleri açısından uyumunu ele almaktadır. Türkiye’nin sosyal ve tarihsel arka planı uyum sürecinde ek zorluklar yaratmaktadır. Sosyal haklara ilişkin kısıtlamalar hem yasal hem de fiili düzeyde devam etmektedir. Bu nedenle Türkiye’nin sosyal politika uyumu için daha fazla çaba harcaması gerekmektedir. study is based on the assumption that social policy is a double-movement process the direction of which leaded by the tension between market liberalisation and social protection. Chapter one, inspired by Polanyi’s framework, argues that the struggle between market liberalisation and social protection shaped the features of the social welfare states. Chapter one challenges the view the welfare states, which have been built over a two centuries period and have survived two world wars, collapsed over the last decades. On the contrary they continued to grow during last two decades. Chapter two explores the improvement of EU social policy and its problems. This chapter criticises the views that European social policy is unimportant. The study suggests that the EU social policy has had important but uneven impacts which come from the nature of the social policy. Challenges creates by globalisation require more supranational solutions rather than national. Therefore, survival of European social model may play a crucial role to protect not only the EU wage-earner but also all employees all over the world. The last chapter assess the sui generis dimension of Turkish social policy and its current state in terms of the Copenhagen criteria and the EU acquis. Difficulties derive from Turkey’s background create additional impasses. Restrictions with regard to social rights persist both in law and practice. Turkey needs to focus further efforts on harmonisation its social legislation with the EU acquis and relevant international norms.
