Abstract
Yerel yönetimlerin elindeki imkânların ve araçların artması, vatandaşın bürokrasi karşısında korunmasının ve yönetimin hukuka ve ihtiyaçlara uygun davranmasının sağlanması gereğini ön plana çıkarmıştır. Yerel yönetimlerin yapı ve işleyiş itibarıyla karmaşık bir nitelik göstermesi, ayrıca günlük hayata artan orandaki müdahalesi, açıklığı ve etkin bir kamuoyu denetimini de gerekli kılmaktadır. Böyle bir şeffaflık ortamı ise yerel yönetimin kendisini dışa açmasını, kamuoyunun, yönetim ve işlemleri hakkında bilgi sahibi olmasını, kararların nasıl ve kimler tarafından alındığını bilmesini gerektirir. Dolayısıyla, yönetilenlerin de elde ettiği bilgiler ışığında yönetime aktif katılabilmesiyle şeffaflık daha etkin hale gelecektir. Bu çalışmada, yönetim-halk ilişkilerinin iyileştirilmesi ve demokratik yönetim açısından yerel yönetim veya merkezi yönetimde gizliliğin istisna, açıklığın temel ilke haline gelmesi ve bunun uygulamalara yansıtılması gerekliliği üzerinde durulmuştur. Açıklığın temel araçlarından olan yönetimin bilgi verme görevi ve yönetilenlerin bilgi edinme hakkı da, bu çalışma kapsamı içerisinde değerlendirilmiştir.
The increase of tools and opportunities held by local governments highlighted the necessity of providing protection for citizens against bureaucracy and assuring that government acts in accordance with law and needs of the public. Complicated nature of local governments in terms of structure and operation and interventions by local government to daily life with an increasing rate creates the necessity of openness and an efficient public superintendence. Such atmosphere of transparency requires local governments exposing themselves to public by supplying information about administration and its operations, identities of decision makers and the process of decision-making. Therefore, with the active contribution of those who are governed, transparency will become more efficient. In this study, the emphasis is on the requirement of making secrecy in local or central government an exception, setting openness as a principal and applying it within operations in order to ameliorate relations between management and public for the sake of democratic administration. Governments duty of informing people and people s right to obtain information as fundamental tools of openness are also evaluated within this study.
