Şeref ve Haysiyete Yönelik Saldırılar Karşısında Kişilik Hakkının Korunması

Abstract

Şeref ve haysiyet kişilik hakkı kapsamında korunan değerlerdendir. Şeref ve haysiyeti hukuka aykırı şekilde saldırıya uğrayan veya böyle bir saldırı tehlikesiyle karşılaşan kimse, 4721 sayılı Türk Medeni Kanunu’nun 25. maddesinde düzenlenen kişiliği koruyucu davaları ve saldırı sonucunda bir zarara uğramışsa maddi ve/veya manevitazminat davalarını açabilir. Ayrıca bu davalar sonucunda verilen kararın üçüncü kişilere bildirilmesini veya ilanınıisteyebilir.Şeref ve haysiyete yönelik saldırılar kişinin ölümü sonrası gerçekleşirse ölenin kişilik hakkının ihlal edildiği söylenemez. Çünkü TMK m.28 gereği kişilik ölümle beraber sona erer. Ancak ölenin şeref ve haysiyetine yönelensaldırılar onun yakınlarının kişilik hakkına tecavüz oluşturur. Bu tür saldırılar karşısında ölenin yakınları, kendikişilik haklarının ihlaline dayanarak, TMK m.25’te düzenlenen davaları açabilir.

Honor and dignity are values protected within the scope of personality right. Anyone whose honor and dignity have been unlawfully infringed or under threat of such an infringement may ask the court for protective actions. If pecuniary and/or non-pecuniary damages occur as a result of the violation, the aggrieved party may claim indemnification for these damages under Article 25 of the Turkish Civil Code (TCC). Besides, he/she may request the court to announce the court decision or to notify third parties about the result of such cases. If the attacks on honor and dignity occur after the death of the person, it cannot be said that the personality right of the deceased person has been violated. Because TCC art.28 states that personality ends with death. However, the attacks on the deceased’s honor and dignity constitute an infringement on personality rights of the persons close to him/her. Persons close to him/her suffered from such attacks may resort to the remedies set out in TCC art.25.
