Publication: Hanefî fıkıh usulü meti̇nleri̇nde sünnet ve Osmanlı usul eserleri̇ne yansıması
Abstract
Bu tezde Osmanlı coğrafyası ve bu coğrafya dışında telif edilen otuz yedi Hanefî usul eserinin “Ahbâr/ Sünnet” adlı bölümlerinin tarihi seyir içerisinde değişiminin görülmesi amaçlanmıştır. Araştırma yapılan konuya dair mevcut literatürdeki çalışmalar göz önüne alındığında kitap, şahıs, coğrafya veya dönemler esas alınarak monografik bir şekilde yapıldığı ve böylece bütüncül bir çerçeve çizemediği görülmektedir. Bu durumun tarihi seyir içerisindeki değişim açısından tatmin edici neticeler sunmadığı düşünülerek daha geniş kapsamlı ve panoramik olarak incelenmesi uygun görülmüştür. Yapılan araştırmalar neticesinde eserlerin ilgili bölümlerindeki konular ve konular içerisindeki taksimlerin farklı olduğu gözlemlenmesi temel problem olarak kabul edilmiş ve bu gözlem sonucundaki farklılıklar somut hâle getirilmek istenmiştir. İncelenmesine karar verilen eserlerin ilgili bölümleri detaylıca tahlil edilerek panoramik şemalar çıkartılmış ve birbirleri ile mukayese edilmesiyle Osmanlı uleması üzerinde etkisi olan usul eserleri tespit edilmiştir. Birbirleriyle irtibatlı olduğu saptanan eserlerin birbirlerinden istifade ettikleri noktalardan da bahsedilerek Hanefi usul eserlerindeki “Ahbâr/ Sünnet” bölümleri özelinde Hanefî usul düşüncesine dair birtakım sonuçlar elde edilmeye çalışılmıştır.
This study aims to highlight the change throughout history of the akhbār/ sunnah sections of 37 books on Hanafī jurisprudence composed within and outside of the borders of the Ottoman Empire. Present studies on this subject matter display a monographic character based on the work, the authors, the regions and eras and thus do not paint a complete picture. Because this previous research is deemed unsatisfactory in showing the change in this topic throughout time, a study with a wider scope and a more holistic approach was seen as appropriate. Following our research, the differences in the aforementioned sections of the works and their subsections were chosen as the central problem of the thesis with the subsequent aim of concretizing these differences. The relevant sections of the books subject to this study were analyzed in detail and diagrams were drawn out. Furthermore, by comparing these diagrams, the works on jurisprudence that influenced Ottoman scholars were identified. Books that shared a connection with each other and the parts that used material from each other were also determined. Finally, some conclusions were drawn about the school of Hanafī jurisprudence with a particular emphasis on the works’ akhbār/ sunnah segments.
