ADLİ KONTROL TEDBİRLERİNE DURUŞMASIZ OLARAKKARAR VERİLEBİLİR Mİ?KİŞİ ÖZGÜRLÜĞÜ VE GÜVENLİĞİ HAKKI BAĞLAMINDABİR İNCELEME

Abstract

Bu çalışmada adli kontrol kararının duruşmasız olarak verilip verilemeyeceği sorusu üzerine bir inceleme yapılmıştır. Özellikle konututerk etmeme tedbirine duruşmasız olarak karar verildiği takdirde kişiözgürlüğüne yapılan bu müdahale sonucunda işletilmesi gereken güvencelerin sağlıklı şekilde korunamadığı tespit edilmiştir. Bu durumda ortaya çıkan sorunların kaynağı ilgili mevzuatın AİHS ve Anayasa ile uyumsuz olmasıdır. Bu nedenle çalışmanın merkezinde yer alan soruya verilecek kategorik yanıt olumsuz olmuş ve süreçlerin hak ihlaline neden olmayacak şekilde yürütülmesi için bazı önerilerde bulunulmuştur.

This study set out to investigate on the question of "can judicial control measures be decided without hearing". It is detected that guarantees for persons deprived of liberty are not protected properly in this way, particularly, when the measure of house arrest is decided. In this circumstances, problems arised from domestic legislations that are not compatible with the Convention and the Constitution. Finally, this disquisition has shown that the question in the center of this study should be answered with “no”, categorically, and also some recomendations are made to provide execution without violation of rights.
