Ez-Zübeyrî’nin (Ö. 317) Kitâbü’l-Müskit adlı eserinin tahkik ve tahlili

Abstract

Fıkıh, İslam kültür mirasını oluşturan ilimler içinde müstesna bir yere sahiptir. Fıkıh ilminin alt-disiplinlerinden biri kabul edilen “Furûk” (Farklar), bu ilmin odaklandığı en ince ve en önemli meseleleri konu edinir. Fıkhî meseleler ve başlıklar arasındaki ilişkilere ve incelik arz eden farklılıklara yoğunlaşan bu konu, ilk dönemlerden itibaren İslam âlimlerinin ilgisini çekmiş; fıkıhla ilgili çalışmaların ve disiplinlerin gelişmesine bağlı olarak bu konuda zaman içerisinde birçok kitap telif edilmiştir. Farklar, hemen bütün fıkıh mezheplerinde müstakil tasnif ve araştırmalara konu olmakla birlikte, özellikle Şâfiî mezhebinde bu alanda birçok metin kaleme alındığı görülür. Bu kitapların en meşhurları, İbn Süreyc’in Kitâbu’l-furûk’u, Ebû Muhammed el-Cüveynî’nin el-Cem‘ ve’l-fark’ı, Sübkî ve Süyûtî’nin el-Eşbâh ve’n-nezâir başlıklı kitaplarıdır. Elde edebildiğimiz bilgilere göre bu konuda yazılan ilk kitap, hicri 317 yılında vefat eden Ebû Abdullah ez-Zübeyr b. Ahmed ez-Zübeyrî’nin el-Müskit adını verdiği eseridir. Zübeyrî kitabını Şâfiî kitaplarında takip edilen sıralamaya göre bablara ayırmamış olup kitabın tertibini Tâcüddîn Muhammed b. Hibetullah el-Hamevî (v. 595) üstlenmiştir. Zübeyrî eserinde, fıkhın muhtelif bablarına ait birçok meseleye değinmiş, birbirine benzeyen konu ve hükümler arasındaki farkları kısa, öz ve tutarlı bir yöntemle ortay koymuştur. İmam Şâfiî’nin görüşlerini ve özellikle Arap diliyle ilgili temel kabullerini takip eden Zübeyrî, Şâfiî mezhebi fukahası arasında sayılmaktadır. Müellif, kitabında geçmiş ulemadan -Şâfiî dışında- nakil yapmaya özen göstermemiştir. Şâfiî’den yaptığı nakillerin mevcut metinlerde bulunması, kitabın güvenilirliğini arttıran bir husus sayılabilir. Bu çalışmanın amacı, el-Müskit’i ilim alemine kazandırmak; kitabı ilmî ve akademik esaslara uygun olarak tanıtıp inceledikten sonra gün yüzüne çıkarmak ve okuyucuların istifadesine sunmaktır. Çalışmamız kitabın metnini dizip yeniden tertip etmekle sınırlı kalmayacak; muhtevası üzerinden yapılacak tetkiklerle müellifin birbirine benzer konuları nasıl ele aldığı, bunları birbirinden nasıl ayırdığı ve hangi yöntemi kullanarak sonuçlara vardığı tespit edilecek ve değerlendirilecektir. Ayrıca tezde, müellifin hayatı hakkında da bilgi verilecek ve hem kendisi hem de fıkıh ilmini tahsil ettiği hocaları ile ilmî silsilesi tanıtılacaktır. Araştırmanın bir diğer amacı, furûk sahasında telif edilmiş bir metin üzerinden fıkhî tefekkürün haritasını açıklamaya yardımcı olacak genel sonuçlar çıkarmak ve bu sayede fıkhî düşünce yönteminin daha iyi anlaşılmasına katkı sunmaktır.

The science of fiqh is considered one of the most important pillars of the scientific structure of Islamic cultural heritage. The subject of differences, which is one of the sub-branches of the science of fiqh, is among the finest and most important subjects that this science focuses on. Islamic scholars have dealt with this important issue even since the first period. Later, in connection with the development of the sciences of fiqh, many books were written and researched on this subject from generation to generation. Although this issue has been handled with separate classifications and researches in other fiqh madhhabs, especially the Shafi sect examined the subject of differences in the form of mesail among the major books of the sect and albeit relatively in later periods, separate books were written under this title. According to the information we can obtain, the first book written on the differences in the Shafi sect is the book written by Imam Fakih Al-Zubairi, who died in about the year 317 of the hegira, and named Kitâb Al-Muskit. He prepared his book according to the order of fiqh chapters known in the Shafi sect and dealt with the most problematic issues in these matters. He distinguished the differences between the similar topics with a short, concise and consistent method.His Holiness the author made many quotations from the past ulama in his book, and he examined the views of this ulama, whose books have not survived until today, by connecting them to true or false.For this reason, students of Islamic sciences need to work on these treasures hidden in cultural heritage cellars. In this context, the aim of this thesis is to reveal this book in accordance with detailed scientific methodologies known in the academic environment and to present it to the readers. This work is not limited to just reorganizing the text of the book. The researcher will examine the text of the book and try to evaluate how the author handles similar issues and how he separates them from each other, and what method he uses. In addition, the researcher will work on the life of the author and try to present the information both about himself and the sequence from which he acquired the science of fiqh. At the end of the study, the researcher will draw general conclusions that will help explain the thought map in terms of fiqh in these nuanced scientific issues, and will provide recommendations for other researchers to better understand Islamic thought and the method of fiqh in the eyes of Islamic scholars.
