Publication: Coğrafi Yer Adlarının Markalarda Kullanılmasına İlişkin Sınırlamalar
Abstract
6769 sayılı Sınai Mülkiyet Kanunu'nda, coğrafi yer adlarını içeren markalara ilişkin olarak özel hükümlere yer verilmiştir. Öncelikle belirtmek gerekir ki bir malın coğrafi kaynağını gösteren işaretleri münhasıran veya esas unsur olarak içeren markalar kural olarak tescil edilemez. Tescil talebine konu olan mallar açısından kullanım sonucu ayırt edici hale gelmeleri koşuluyla bu işaretlerin tescilleri mümkün olabilir. Her ihtimalde, marka, malın coğrafi kaynağı yönünden halkı yanıltmayacak nitelikte olmalıdır. Son olarak, coğrafi işaretten oluşan veya coğrafi işaret içeren işaretlerin marka olarak tescil edilmesi mümkün değildir. Ancak garanti markaları açısından bu noktada farklı bir inceleme yapmak gerekir. Bazı koşullar altında, coğrafi işaret içeren garanti markalarının tescil edilebileceği kabul edilmelidir.
In the Industrial Property Law no. 6769, there are some special provisions for trademarks which contain the geographical names. It is necessary to indicate firstly that, as a rule, trademarks which consist exclusively of signs which may serve to designate geographical origin of the goods shall not be registered. Their registrations may be possible provided that these trademarks has become distinctive in relation to the goods for which registration is requested in consequence of the use which has been made of it. In any case, a trademark should not be deceptive in the sense of the geographical origin of good. Finally, it's not possible to register signs which consist of a geographical indication or which contain geographical indication as a trademark. But it is necessary to make a different analysis for the guarantee marks at this point. Under certain circumstances, it should be accepted that guarantee marks containing geographical indications may be registered.
