İş hukukunda işverenleri̇n asıl i̇şveren alt işveren ili̇şki̇si̇nden kaynaklanan müteselsi̇l sorumluluğu

Abstract

Alt işverenlik ilişkisinde, asıl işveren ile alt işveren işçisi arasında herhangi bir sözleşme ilişkisi bulunmamasına rağmen, alt işveren işçisini korumak ve haklarını güvence altına almak amacıyla, asıl işverenin alt işveren işçisine karşı alt işverenle birlikte müteselsilen sorumlu olduğu kabul edilmiştir. İş Kanunu’nun 2. maddesine göre, asıl işveren, alt işveren işçilerine karşı o işyeri ile ilgili olarak bu Kanundan, iş sözleşmesinden veya alt işverenin taraf olduğu toplu iş sözleşmesinden doğan yükümlülüklerinden alt işveren ile birlikte sorumludur. Söz konusu maddede birlikte sorumluluk olarak ifade edilen aslında müteselsil sorumluluktur. Müteselsil borçluluk, borçluların her birinin alacaklıya karşı borcun tamamından sorumlu olduğu, alacaklının borcun ifası için dilediği borçluya başvurabildiği, alacaklının müteselsil borçlulardan biri tarafından tatmin edildiği ölçüde borcun diğer borçlular için de sona erdiği bir borçluluk ilişkisidir. Çalışmamızda, alt işverenlik ilişkisinde asıl işverenin ve alt işveren/ lerin sorumluluğu, iş hukukuna ilişkin esasların yanı sıra müteselsil borçluluğun borçlar hukuku ve usul hukuku boyutları da ele alınarak incelenmiştir. Alt işverenlik ilişkisinin hukuki niteliğinin müteselsil borçlulukta önem arz ettiği ve gözetildiği durumlara yer verilmiştir. Müteselsil sorumluluğun alt işverenlik ilişkisindeki uygulaması, öğreti görüşleri ve yargı kararları dikkate alınarak değerlendirilmiştir.

In the principal employer sub-employer relationship, although there is no contractual relationship between the principal employer and the sub-employer's employee, it has been accepted that the principal employer is jointly and severally liable towards the sub-employer's employee, together with the sub-employer, in order to protect the sub-employer's employees and secure their rights. According to Article 2 of the Labor Law, the principal employer is responsible towards the sub-employer's employees, together with the sub-employer, for the obligations arising from this Law, the employment contract or the collective labor agreement to which the sub-employer is a party, regarding that workplace. What is referred to as joint liability in the said article is actually joint and several liability. Joint indebtedness is an indebtedness relationship in which each of the debtors is responsible for the entire debt to the creditor, the creditor can apply to any debtor of his choice for the performance of the debt, and the debt ends for the other debtors to the extent that the creditor is satisfied by one of the joint debtors. In our study, the liability of the principal employer and sub-employer(s) in the subcontracting relationship is examined by addressing the principles of labor law as well as the law of obligations and procedural law aspects of joint and several liability. Situations where the legal nature of the principal employer sub-employer relationship is important and taken into account in joint and several indebtedness are included. The application of joint and several liability in the principal employer sub-employer relationship is evaluated by considering the doctrinal opinions and judicial decisions.
