Türk ceza hukukunda önödeme kurumu

Abstract

Son yıllarda, ekonomik suça ekonomik ceza anlayışı gelişmiş, bu nitelikteki suçların cezaları para cezası olmuş ve bu durumda önödemenin uygulanabilirliğini arttırmıştır. Bu sebeple bu konuyu yeniden ele almaya çalıştık. Üç bölüm halinde yaptığımız bu çalışmanın ilk bölümünde , Önödemenin Tanımı, Hukuki Mahiyeti ve Tarihi Gelişimi üzerinde durduk. İkinci Bölümde Önödemenin Şartları, Çeşitleri ve Sonuçlarını ele almaya çalıştık Sonuç bölümünde ise Ceza Kanunu ve Ceza Usul Kanunu Tasarılarında Önödeme ile Bu kuruma benzer kurumları inceledik, bu konuya ilişkin değerlendirmelerimizi ve önerilerimizi belirttik.

In this years, the comprehensior of cconomic cunishment for economic crime has been developed, and the punishment of this type of crime had been fine, in this case the importance of the Friendly Settelement has increased. Thus, we examined that that subject. We study in three main part , and in the first part , we examine The Definition, The Lawful Contents and the The Historical Development of the Friendly Settelement. İn the second part, we study about the Terms, the Types and the results of that.Finally we search the similar concept and Friendly Settelement in The Turkish Criminal Code and The Code of Criminal Procedure, and we indicated our suggestion and apprecation in the conclusion
