Abstract
Konkordato süreci; finansal zorluğa düşen şirketleriniyiniyet çerçevesinde belli bir süre korumaaltına girmesini sağlamayı amaçlamaktadır. Bu süreçiçerisinde şirketler geriye dönük olan borçlarınıileri vadede ve belli bir oranda indirimli olaraködeme imkanı bulabilmektedir. Şirketler konkordatoiçin mahkemeye başvuru sırasında kayıtlı verayiç değer bilançolarını sunmak durumundadırlar.Aynı zamanda hazırlanan ön proje ekinde şirketinhangi kaynaklardan, hangi sürede borçlarını ödeyebileceklerinigöstermeleri gerekmektedir. Buşekilde hazırlanan finansal raporların ve ödemeplanının alacaklılar tarafından görülmesi ve onaylanmasızorunludur. Bundan sonraki önemli olansüreç, şirket yönetiminin bu plana uyabilme imkanınıoluşturabilmesidir. Konkordato sürecindeki finansalraporların gerçeğe ve amaca uygun hazırlanması,hem alacaklıların ikna edilmesine hem deborç yönetimine önemli katkı sağlamaktadır. Buçalışmada konkordato süreçleri anlatılarak, ABCA.Ş.’ye ait finansal tablolar üzerinde konuya ilişkinörnek bir uygulama yapılmıştır.
The concordat process aims companies which are in financial difficulty to be under preservation within the frame of goodwill. During this period companies have the opportunity to pay their retrospective debts at a later date and a proportionally reduced rate. Companies have to submit their book and current value balance sheets during application to the court for concordat. Additionally in the annex to the preliminary project the company is required to specify that from which sources they can pay their debts in how long time. It is obligatory that financial reports prepared in this manner and payment plan are seen and approved by creditors. The following important process for company management is to provide opportunity to comply with this plan. Preparing realistic and expedient financial reports during the concordat process , makes a significant contribution to persuade creditors and also debt management. In this study, a related model application has been performed on financial charts of ABC Inc. Co. by explaining concordat processes.
