Abstract
Osmanlı Devleti'ndeki şer'i mahkemelerde hukuki bütün meseleler Hanefi mezhebi üzere halledilirdi. Aynı zamanda şehir ve kasabaların belediye işleri bugün ki noter gibi vekâletnâmeler, alım-satım muameleleri tanzimi de bunlara aitti. Hükümetin mahalli herhangi bir iş hakkında göndermiş olduğu fermanların infaz ve tatbiki de bu kadılar tarafından yapılmaktaydı. Elimizde çalıştığımız defter İstanbul Kadılığı 6 numaralı şer'iye sicilidir. Bu defterde hicrî 11 Cemaziye'l-ûlâ 1029 - 30 Cemaziye'l-ahire 1029 tarihleri arasında kayıtlar yer almaktadır. Çalışmamızda şer'iye defterinin transkripsiyonu yapılmış ve hüccetlerin özetleri çıkartılmıştır. Daha sonrada bunlara dayanılarak değerlendirme yapılmıştır. Defterimiz de İstanbul, Rumeli ve Anadolu Sancak ve kazalarına ait sosyal, ekonomik ve idari durumu gösterecek örnekler de mevcuttur. Arapça hüccetler orjinal haliyle konulmuştur. Bu defterde emlâk ve arazi alım-satımı, kiralanması, alacak-verecek davaları, cariye ile ilgili hükümler, vakıflara ait hükümler, evlenme boşanma, kefalet, ortaklık kurma, vekâlet, kısas, sulh vb konulara ait hükümler bulunmaktadır.
The Canonical courts in the Ottoman Empire had been depending on the Hanafi school to solve all their legal and juridical issues. In the same time they had to deal with power of attorney to organize the way of buying and selling as the same as today's city and town's municipalities do. When ever the government sent an order ''firman'' the judge had to carry it out in the level of implementation. Our work here is depending on the register no. VI of the Canonical record ''şer?iye sicili'' of Istanbul district judge. This register according to the Muslim Calendar dealt with the period between 11 Cemaziye'l-ûlâ 1029 - 30 Cemaziye'l-ahire 1029. In this study of the Canonical record we have done a transcription of the whole register beside a summary of the arguments. Depending on that analyze has been made. In this register there are many samples that has shown the administrative, economic and social conditions of areas related to Istanbul, Rumelia and Anatolia. For the Arabic arguments it has been attached as it is without any change. However, this register shows judicial decisions concerned with claims of selling or buying, renting, taking or giving properties and lands, female slave, pious foundations, marriage or divorce, guarantee, partnership, representative of an other, retaliation and reconciliation etc.
