Abstract

TRAFİK GÜVENLİĞİNİ TEHLİKEYE SOKMA (TCK 179/ 3)Teknoloji her gün hayatımıza yenilikler katmaktadır. Bu yeniliklerin kendisini en çok hissettirdiği alanların başında otomotiv sanayisi gelmektedir. Araçlar daha güçlü motorlara sahip oldukları için daha hızlı gitmekte ve insan hayatı için de daha çok tehlike arz etmeye başlamıştır. Bu tehlikenin farkında olan kanun koyucu, trafik kuralları ile birlikte bu kuralların uygulanmasını sağlayan cezai yaptırımlar düzenlemiştir. Bu düzenlemelerin içinde trafik güvenliğini sağlamaya yönelik 5237 Sayılı Türk Ceza Kanununda 179. maddesi yer almaktadır. TCK 179. maddesi, üçüncü kısım topluma karşı suçlar, genel tehlike yaratan suçlar altında, üç fıkra olarak düzenlenmiştir. TCK 179. maddesi üçüncü fıkrasında, inceleme konumuz olan alkol veya uyuşturucu madde etkisiyle ya da başka bir nedenle emniyetli bir şekilde araç sevk ve idare edemeyecek durumda olmasına rağmen araç kullanan kişilerin cezalandırılmasını öngören inceleme konumuz olan suç düzenlenmiştir.İnceleme konumuz olan tezi üç bölümde incelemeye çalıştık. Birinci bölümde, suçun 5237 Sayılı TCK’ya nasıl girdiği ve hangi ceza kanununun kaynak olarak alındığını anlattıktan sonra, çalışma konumuzu oluşturan kanun metni, gerekçesi ve bu metni yorumlamaya faydalı olacak tanımları yardımcı kaynaklarla birlikte açıklamaya çalıştık. İnceleme konumuzun daha net anlaşılması açısından benzer suçlardan farkını kısaca ortaya koyduk. İkinci bölümde, daha çok suçun temel unsurları ve kusurluluk üzerine yoğunlaştık. Üçüncü bölümde ise suçun görünüş biçimleri ile diğer hususları anlattık. Son olarak da elde ettiğimiz sonuçları anlattığımız sonuç bölümü ile çalışmamıza son verdik.

Jeopardize Traffic Safety (TPC 179/ 3)Technology brings innovations to our lives every day. The automotive industry is one of the areas where these innovations make itself felt the most. As vehicles have more powerful engines, they go faster and become more dangerous for human life. Aware of this danger, the legislator has issued criminal sanctions, which together with traffic rules, ensure the enforcement of these rules. Within these regulations, Article 179 of the Turkish Penal Code No. 5237, which aims to ensure traffic safety, is included. Article 179 of the TPC, the third section is organized under three paragraphs under the offenses against society and the first section under the general danger. In the third paragraph of Article 179 of the TPC, the criminal offense which regulates the punishment of the people who drive the vehicle, despite the fact that it is unable to safely drive and handle the vehicle due to the effect of alcohol or drugs or another reason, is regulated.We tried to examine the thesis, which is our subject of study, in three chapters. In the first part, after explaining how the crime entered the Turkish Penal Code No. 5237 and which criminal law was taken as a source, we tried to explain the text of the law, the rationale and the definitions that would be useful to interpret this text together with the auxiliary resources. We have briefly demonstrated the distinction from similar offenses in order to understand our subject matter more clearly. In the second part, we focused on the basic elements of crime and imperfection. In the third part, we explained the appearance of crime and other issues. Finally, we ended our study with the results section where we explained the results we obtained.
