Yürütmenin durdurulması kurumunda uygulanmakla etkisi tükenecek idari işlemler

Abstract

2012 yılında 6352 sayılı Kanunla yapılan değişiklikle yürütmenin durdurulması kararı verilebilmesi için idarenin savunmasının alınması veya savunma süresinin beklenilmesi genel bir koşul olarak getirilmiştir. Bu koşulun istisna alanı, uygulanmakla etkisi tükenecek idari işlemler adıyla kavramsallaştırılmıştır. Ancak kanun koyucu tarafından kavramın tanımı yapılmamıştır. Sadece kanun gerekçesinde yıkım ve sınır dışı etme kararları örnek olarak gösterilmiştir. Daha sonraki yapılan değişiklikle kamu görevlisi hakkındaki bazı işlemler, kavram dışında bırakılmıştır. Bu çalışmada kavramın kuramsal çerçevesi çizilmeye ve mahkeme kararlarına yansıyan örnekler üzerinden kapsamı belirtilmeye çalışılmıştır. Kuramsal çerçeve, Hukuk devleti, idarenin yargısal denetimi ve yürütmenin durdurulması kavramları ışığında ele alınmıştır. Kuramsal çerçeve kapsamında kavramın tanımı, amacı ve koşulları incelenmiştir. Ayrıca kavram, idari işlem teorisi bakımından değerlendirilmiştir. İkinci bölümde kavramın mahkeme kararlarında nasıl ele alındığı ve hangi işlemler için kullanıldığı gösterilmiştir. Bu bölümde, ayrıca, mahkeme kararlarında uygulanmakla etkisi tükenecek idari işlem olarak değerlendirilmeyen ama o nitelikte olduğu düşünülen işlemler alanı oluşturulmuştur.

In this study, the theoretical framework of the concept is tried to be drawn and the scope is tried to be expressed through the examples reflected in the court decisions.The theoretical framework is discussed in the light of the concepts of the rule of law, judicial review of the administration and the stay of execution. Within the theoretical framework, the definition, purpose and conditions of the concept are examined. Also, the concept has been evaluated in terms of 'administrative action theory'. In the second chapter, it has been shown how the concept was handled in court decisions and used for which administrative actions. Also, In this section, in court decisions, a field of transactions which are not considered administrative actions that end of effect by implementing but they have these qualities , have been established.
